HomeMy WebLinkAbout1971 008 CC RESO1971 008 CC RESO(Ììæ4RESOLUTION NO. 71-8 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 70-N-91) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 3409-3413 Frazier Street more particularly described as follows: Lot 11 of Tract No. 11045. 8551-1-13) c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq./ of theiBaldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report/ relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property/ or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 90 days from the date here- of, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION; 3419-21 Frazier Street II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general yard cleanup. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Sections of the City Fire Code being violated are: 13.25 vacating premises, 13.26 vacant building, 13.37 unsafe building, 27.113 accumulation of waste materials. Premises shall be left in a clean and neat condition, unsafe premises due to doors and windows open, inadequate maintenance and accumulation of dry grass and litter. Recommend correct violations of fire code as stated and remove accumulation of all combustible materials. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Sections 628, 630, 808 and 809 of Los Angeles County Health Code Ordinance 7583 are being violated. Four dwellings, shed and animal cage all have hazardous entrances broken windows and doors). Unsanitary plumbing and/or inadequate toilet facilities; excessive trash and garbage roaches. Recommend elimination of substandard dwellings and repair to code dwellings that can be saved, remove all trash and garbage to prevent rodent harborage and breeding of roaches and flies. 3. BALDWIN PARK POLICE DEPARTMENT: Crime report on this property is as follows: 11/14/69, runaway juvenile, CR69-3986; 12/13/68, 459 P.C. CR68-4476. 3413 Frazier Location is insecure. Large amount of debris. Posted unsafe for human occupancy, 4. BALDWIN PARK PLANNING DEPARTMENT: The structures on this property do not conform to the present zone and general plan. Violations are two structures on one lot, trash, debris/ nonconforming sheds and disabled vehicle in rear yard. Recommend removal of trash, debris and disabled vehicle, raze all sheds and general clean up and paint up. 5. BALDWIN PARK BUILDING DEPARTMENT: Property posted 10/14/70. Recommend complete rehabilitation of both main houses, return garage to original use, demolition of all other structures and connecting roofs and complete yard cleanup.
