HomeMy WebLinkAbout1971 009 CC RESO1971 009 CC RESO(Ììæ.RESOLUTION NO. 71-9 RESOLUTION OF THE CITY COUNCIL OP THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 70-N-92) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find/ determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 3834-36 Vineland Avenue more particularly described as follows: Lots 10 and 11 of Tract No. 8705. 8554-8-10) c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner se-c'forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 50 days from the date here- of, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 3834-36 Vineland Avenue II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general yard cleanup. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Sections of the City Fire Code being violated are 13.25 vacating premises, 13.27 unsafe buildings and 27.113 accum- ulation of waste materials. Recommend correct violations of Fire Code as stated and remove accumulation of all combustible materials. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Violations are sections 808 and 809 of the Los Angeles County Public Health Code Ordinance 7583. Defective sewage and waste water disposal facilities, roaches, trash and debris. Recommend abate substandard dwellings, eliminate rodent harborage possible) and roach infestation. i \ 3. BALDWIN PARK POLICE DEPARTMENT: Crime reports are 9/14/68 missing juvenile CR68-3199; 459 PC 8/9/67 CR67-2571. 3834 Vineland Location is, a one story wood exterior residence in general run down condition. Mis- cellaneous junk items and auto parts in front yard. Owner should be advised to clean up property to prevent an attractive nuisance for juveniles. Location is posted unsafe for human occupancy by City and it is apparent the property has been improved to a certain degree. 3836 Vineland Location is a one story wood exterior structure intended as two individual apartment rooms. The location is unoccupied and posted unsafe for human occupancy by City. All doors and windows are sec-jre owner should be advised to eliminate structure and consider reconstruction to coincide with Health and Building statutes. 4. BALDWIN PARK PLANNING DEPARTMENT: The structures on this property do not conform to the present zone two single family structures on the lot. Violations are non-conforming single family residence, no paved driveways and weeds. Recommend general cleanup. 5. BALDWIN PARK BUILDING DEPARTMENT: Both houses posted 10/14/70. These two houses are in very poor condition. Recommend complete rehabilitation or demolition. It is recommended that the Public Nuisance be abated by the following: 1.
