HomeMy WebLinkAbout1971 010 CC RESO1971 010 CC RESO;¢fìéRESOLUTION NO. 71-10 RESOLUTION OF THE CITY COUNCIL OP THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 70-N-94) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq./ of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 13146 Francisquito Avenue more particularly described as follows: Tract No. 12445 lot commen- cing at most easterly corner of Lot 88 thence northwest-on south- westerly line of Francisquito Avenue 56.41 feet thence southwest on northwesterly line of said lot, 90 feet thence southeast to southeasterly line of said lot thence northeast thereon 102 feet to beginning part of Lot 88. 8551-3-34) c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing/ it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 90 days from the date here- of, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 13146 Francisquito Avenue II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general lot cleanup. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Section 13.27 of the City Fire Code is being violated un- safe building. Dwelling vacant and open, evidence inside indicated burned paper in an attempt to possible deliberately set building on fire. Recommend properly secure building from entry 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Violations are Los Angeles County Public Health Code/ Sections 808 and 809. House) defective doors, screens, windows and damage to interior walls and floors. Garage) hazardous en- trance, lack of adequate roof, defective windows, floors and walls. Recommend repair or replace garage. Bring house up to code to eliminate substandard dwelling. 3. BALDWIN PARK POLICE DEPARTMENT: Crime report stolen vehicle, 2/21/70 CR70-0649. This location is a one story stucco residence. The structure is in a general run down condition and tagged as unsafe for human occupancy. The house is at this time unoccupied. Ashes were observed in the fireplace and a burnt torch on the kitchen floor, indicating that the location had had visitors. The location is not securable due to broken windows. The yard is cluttered with trash and debris. Recommend the location be repaired and secured by the owner or torn down as a hazard to public safety. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does conform to the present zone but not to the general plan shows R-2. Violations are weeds, disabled vehicle stored at rear of non-conforming garage. Rec- ommend remove vehicle, rehabilitate garage and general cleanup. 5. BALDWIN PARK BUILDING DEPARTMENT: There are two i1 legal rooms buiIt on to house no permi ts. One is encroaching into the easement, the other is in rear yard area. The shed across the drive is substandard in every way. Property posted 7-28-70, meter pulled 7-29-70. Recommend complete demoli- tion of shed structure on opposite side of drive and complete demolition of both illegal rooms mentioned above. Demolish both illegal additions to residential structure and correct all other building violations. 3. Conduct general lot cleanup.
