HomeMy WebLinkAbout1971 011 CC RESO1971 011 CC RESO;¢fìêVRESOLUTION NO. 71-tl RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 70-N-95) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated'to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 15000 Nubia Street more particularly described as follows: Tract No. 7701 lot commencing at southwest corner of Lot 19 thence north 0° 42' 35" east 59.90 feet thence south 89° 57' 30" east 123.17 feet thence south to southerly line of said lot thence west thereon 123.13 feet to beginning part of Lot 19. 8414-22-22) c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance/ and that the public interest requires that the same be abated; and e) That the staff report/ relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 60 days from the date here- of, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 15000 Nubia Street II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general lot cleanup. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Violations are Section 13.27, unsafe buildings, delapidated sheds exist on property and Section 27.113, accumulation of combustible rubbish in sheds. Recommend removal of all combustible waste material. Repair, rehabilitate, demolish or remove sheds. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Violations are Los Angeles County Public Health Code, Sections 628, 808 and 809. Substandard sheds and garage, house converted to chicken shed, house has no heat, low ceiling, defective doors, windows. Walls and ceiling in sheds defective also filled with cast off lumber and building materials. Recommend elimination of possible rodent harborage and repair or replace substandard buildings. 3. BALDWIN PARK POLICE DEPARTMENT: Crime report on this property: Runaway juvenile 6/3/70 CR70-1884; 242 P.C. 3/3/69, CR69-0808-BRJ69303; Missing juvenile 6/19/68 CR68-2088; 459PC 11/4/67 CR67 3547; 242 P.C. 3/7/69 CR69-0808- ARJ 69-302. Location is a one story flat roof residence, asphalt tile exterior- A large run down shed or barn is attached at the northeast end of the residence. The north side of the shed has been marked up badly by juveniles with assorted colors of paint. The entire structure is run down and is frequented by juveniles. Recommend reconstruction by property owner to dissolve all existing deficiencies. Location appears to be a gathering point for juveniles and could be an attractive nuisance. 4. BALDWIN PARK PLANNING DEPARTMENT: Violation of zoning code is weeds. Recommend general cleanup. 5. BALDWIN PARK BUILDING DEPARTMENT: This structure is a converted chicken house. The portion to the rear is still a shack. The structure was posted as unsafe in 1966 and some work was done to correct illegal wiring and firewall protection soon after. It is recommended that this entire struc- ture be demolished or brought up to all existing codes. Bringing to Code will necessitate demolition and starting over) It is recommended that the Public Nuisance be abated by the following: 1.
