HomeMy WebLinkAbout1971 012 CC RESO1971 012 CC RESO;¢fìêPRESOLUTION NO. 71-12 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 70-N-97) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 3509 Maine more particularly described as follows: Lot 1 of Tract Mo. 13175. 8551-1-28) c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 90 days from the date here- of, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structure and general yard cleanup. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT; IJo notices of violation have been issued by the Fire Department. Sections of the city Fire Code being violated are: Section 13.27, unsafe buildings and Section 27.113, accumulation of waste material. Conditions in violation of the city Fire Code are: dilapidated out buildings exist on property. Large quantity of combustible rubbish strewn all over prop- erty This includes dry weeds, dry lumber, uncared for trees and plants. A complete inspection of prop- erty was not possible due to large dog on premises preventing entry. No action has been taken through weed abatement division. Recommend complete removal of all combustibles considered rubbish or waste. Repair, rehabilitation/ demolition or removal of out buildings. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Sections 808, 809, 628, 630, 631 and 632 of the Los Angeles County Public Health Code are being violated. The front house is occupied as well as a substandard shed in rear. Excessive trash and garbage, rags, tires, lumber and trimmings. Garage filled with same. Four dead ducks and stagnant water pond. Shed has defective exterior walls and roof. The structure is occupied. Recommend elimination of possible rodent harborage and fly breeding. Remove or repair rear shed to eliminate substandard problems. 3. BALDWIN PARK POLICE DEPARTMENT: Crime reports issued on this property: 459 PC, 4/15/69, CR69-1284; 459 PC, 3/10/69, CR69-0899; 459 PC, 10/5/67, CR67-3204; Missing Juv., 4/28/69, CR69-2186 and 245 PC, 8/23/70, CR70-3015. No patrol problems. Location occu- pied at time of inspection. 4. BALDWIN PARK PLANNING DEPARTMENT: Does not state on report whether structure conforms to zone, general plan or if there are any future streets planned according to the general plan. Violations include, weeds, debris, wood, etc. Recommend general cleanup. BALDWIN PARK BUILDING DEPARTMENT: Does not conform to code and cannot be made to conform to code. Posted stop work. Shack being used for living and has been added to several times illegally. Also other violations per notice dated 6/5/68. There is a record of building violations being filed against this property. Estimated present work of structure, shack, none. Recommendations: Owner was informed that he was living illegally in a substandard shack. He was told to vacate and demolish. It is recommended that the Public Nuisance be abated by,the following 1. Owner occupant be evicted and very substandard shack be demolished. Pictures A, C, D, E, F, and G. 2. Demolish shed in Pictures H and J. 3. Conduct general yard cleanup.
