HomeMy WebLinkAbout1971 013 CC RESO1971 013 CC RESO;¢fìêJRESOLUTION NO. 71-15 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 70-N-100) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find/ determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 3317 N. Baldwin Park Boulevard more particularly described as follows: Lot 24 of Tract No. 11499. 8552-23-13) c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq. of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance? and d) That as a result of the evidence presented at said hearing, it was determined that the sam<* does constitute a public nuisance, and that the public interest requires that the same be abated? and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 60 days from the date here- of, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 3317 N. Baldwin Park Boulevard II. ZONING: R-3 III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structure and general lot cleanup. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: No notices of violations have been issued by the Fire Department. Section 13.27 of the city Fire Code is being violated. Condition in violation of the city Fire Code is an unsafe building. No action has been taken through weed abatement division. Recommend correct unsafe conditions. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Sections 808 and 809 of the Los Angeles County Public Health Code are being violated. Two story structure over garage. Deteriorated stairs leading to second floor. Defective supporting beams. Deteriorated exterior and interior walls and floor coverings. Defective toilet. Yard with household articles and trash. Structure is vacant.* Recommend repair or replace structure so that the substandard dwelling is abated. 3. BALDWIN PARK POLICE DEPARTMENT: Crime report on this property: 6/13/66, Y-288a & 288 PC, CR66-1721. No patrol problems. Contacted owner, Pauline Choriks, who stated that she was going to have the building torn down. Building is insecure and posted unsafe for human occupancy. Contacted neighbors who stated that no problem has occurred due to building being vacant. The building is an extreme hazard if juveniles decided to play in same. Owner lives at 3309 Baldwin Park Boulevard. 4. BALDWIN PARK PLANNING DEPARTMENT: Structure does not conform to the present zone nor to the general plan. There are future streets planned on or near this property according to the general plan Violations include: distance between dwelling units less than Baldwin Park Municipal Code requirements. Non-conforming shed rear of single family residence. Non-conforming single family residence over garage. BALDWIN PARK BUILDING DEPARTMENT: Does not conform to code and cannot be made to conform to code. Posted as unsafe 10/15/70. Meter pulled on 10/16/70. This building is structurally unsafe and it should be demolished without delay. It is recommended that the Public Nuisance be abated by the following 1. Demolish two story structure. 2.
