HomeMy WebLinkAbout1971 015 CC RESO1971 015 CC RESO8f;¢fê?RESOLUTION NO. 71-15 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE.SAME ABATED 70-N-104) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: j a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 13419 Los Angeles Street more particularly described as follows: Lot 23 of Tract No. 18369 8537-10-6) c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of'the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property/ or others having an interest therein/ shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 60 days from the date here- of, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 13419 Los Angeles Street II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general yard cleanup. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Section 13.26 of the City Fire Code is being violated. Build- ing improperly secured. Recommend correct unsafe conditions. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Los Angeles County Health Code Ordinance 7583, Sections 628, 808 and 809 are being violated. Garage doors and windows missing, two refrigerators and household articles in garage, questionable heater and water heater, defective floor cover- ings, clogged toiler that also leaks, defective wall around tub, evidence of roaches. Backyard filled with couch, T.V. and shed with trash and weeds. Recommend elimination of roach infestation and repair houst to eliminate substandard problem. 3. BALDWIN PARK POLICE DEPARTMENT: Crime report: 503 P.C. 11/7/70 CR 70-4069; 488 P.C. 11/10/69 CR69-3923. Location not secure making easy entry for any one. Rear yard opens into an alley which would assist prowlers and/or burglars to hide from police. Recommend location be boarded up and building secured. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does conform to present zone and general plan shows low density. No future streets planned on or near this property. There are no zoning violations. Recommend general cleanup. 5. BALDWIN PARK BUILDING DEPARTMENT: There are violations in structure framing, footings, electrical and plumbing. This is the second time the owner had to be notified of these violations. The first notice was ignored. Owner attempted to move in renter while notices were posted. Recommend that the building be brought up to all present code requirements. It is recommended that the Public Nuisance be abated by the following: 1. Rehabilitate to present Building Code or demolish. 2. Conduct general lot cleanup. All pictures. Note: This is a second filing on this^property.
