HomeMy WebLinkAbout1971 016 CC RESO1971 016 CC RESO8f;¢fê9RESOLUTION NO. 71-16 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 70-N-106) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS; SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 14930 E. Pacific Avenue more particularly described as follows: Lot 6 of Tract No. 13079 except that portion of dedicated street. 8438-23-29) c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abates said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 90 days from the date here- of, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 14930 E. Pacific Avenue II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general yard cleanup. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Section 13.27 of the City Fire Code is being violated. Build- ing next to house is unsafe. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Sections 628, 808 and 809 of the Los Angeles County Public Health Code, Ordinance 7583 is being violated. Garage area substandard, defective walls, floors and ceiling/ overgrown with ivy. Exterior of house in bad repair/ defective screens. House locked at time of inspection. Yard contains weeds, leaves and some trash. Recommend elimination of possible rodent harborage and abate substandard problem. 3. BALDWIN PARK POLICE DEPARTMENT: Patrol impossible from vehicle due to depth of'lot. Numerous hazards to public safety at rear of house. Location is a large lot approximately 100 x 450 feet. There are three wooden structures, a one story one family house and two out buildings. The house is secure, the out buildings cannot be secured. Out- buildings could become an attraction to juveniles, as a gathering place. Hazards run down buildings, holes dug in ground, trash and debris. Recommend out buildings be torn down, and house be restored or destroyed. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does conform to the present zone and general plan. There are future streets planned on or near this property according to the general plan. Violations are: no paved driveway and non-conforming carport. Recommend raze non-conforming carport and general cleanup. 5. BALDWIN PARK BUILDING DEPARTMENT: The structure framing and footings do not conform to code. Electrical fixtures, plugs and switches are missing. Hazardous wiring on exterior of building. Open water lines, water heater vent, no heat in house or vent over stove. Posted 11/16/70. Meter pulled 11/27/70. Recommend carport shed and complete re- habilitation of house to conform to code requirements.
