HomeMy WebLinkAbout1971 020 CC RESO1971 020 CC RESO8f;¢fê+RESOLUTION NO. 71-20 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK GRANTING A ZONE VARIANCE APPLICATION APPLICANT: BERTHEL; CASE NO. ZV-230; LOCATION: 13834 E. OLIVE STREET). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Baldwin Park does hereby find, determine and declare, as follows: a) That the owners of certain real property, hereinafter described, have hereto- fore made application for a zone variance to allow certain encroachments of accessory buildings in required yard areas; and b) That the property to which said variance relates is as described on Exhibit A" attached hereto and incorporated herein by this reference; and c) That the said variance matter was heard by the Planning Commission and the same was denied by said Commission; and d) That a timely appeal was filed, appealing the decision of the Commission to the City Council; and e) That the City Council conducted a duly noticed public hearing upon said matter, and based upon the evidence presented at such hearing, applicable staff reports and each member of the Council being familiar with the site, the City Council determined that the facts required by Section 9471 of the Baldwin Park Municipal Code were present and that the variance should be granted, subject to certain conditions as hereinafter set forth. SECTION 2. That the above described zone variance be, and the same hereby is, granted subject to the following conditions: a) That the development as proposed, shall conform, substantially with those certain exhibits submitted to, and approved by, the City Council, marked, respectively, Exhibits A" and B", on file with the City Clerk; and b) That the said development shall contain 22 apartment units and shall provide, at all times, not less than 50 off-street parking spaces therefor; and BIB] 37831-U01 1971-U02 020-U02 CC-U02 RESO-U02 LI3-U03 FO10488-U03 FO11507-U03 DO19657-U03 C6-U03 RESO-U03 7/28/2003-U04 ROBIN-U04 1971 020 CC RESO8f;¢fê+RESOLUTION NO. 71-20 c) That the southerly wall of the garage which is proposed for location immediately adjacent to the southerly property line, and the westerly wall of the garage proposed for location immedi- ately adjacent to the westerly property line of the subject property, shall comply with the 4-hour fire wall construction requirements of the City Building Regu- lations, and further that the exterior portion of said garage walls shall be surfaced with slump stone, scored block or other appropriate decorative material as approved by the Director of the Planning Commission. SECTION 3. That the City Clerk shall certify the adoption of this Resolution and shall cause a copy hereof to be forwarded to the applicant and to the Secretary of the Planning Commission.
