HomeMy WebLinkAbout1971 024 CC RESO1971 024 CC RESO;¢fìêRESOLUTION NO. 71-24 RESOLUTION OP THE CITY COUNCIL OP THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OP A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 70-N-102) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS; SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 1324 Virginia Avenue more particularly described as fpllows; Licensed Surveyor's Map as per Book 23, Page 24 of Licensed Survey that portion in Baldwin Park northwest of Walnut Creek Wash per FM 12407-2 of Lots 13 and 14. 8558-31-39) c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq. of the Baldwin P.irk Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and j i d) That as a result of the evidence presented at said j hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 60 days from the date here- i of, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 1324 Virginia Avenue II. ZONING: M-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general lot cleanup. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: No notices of violation have been issued by the Fire Department. Section 13.27 of the city Fire Code is being violated. The violation is an unsafe building. No action has been taken through weed abatement divi- sion. Recommend correct unsafe conditions• 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Sections 808 and 809 of the Los Angeles County Public Health Code are being violated. Conditions existing are: garage with defective walls, roof with an added room with defective floor coverings, doors and ceiling. House locked at time of inspection looked through win- dows) defective floor covering and wall on porch and holes in exterior walls of dwelling. The structure is vacant. Recommend abate substandard problem on dwelling 3. BALDWIN PARK POLICE DEPARTMENT: No crime reports on property and no patrol problems. One story stucco residence, unoccupied and secure on all sides. Residence is free of vandalism. Property is clean. L'as been alleviated by owner or agent. Location is posted unsafe for occupancy. Property clean at this time. 4. Recommend complete demolition ot all structures. Dwelling in an M-l zone. Garage in poor condition. Hobby shop being used as a dwelling and was illegally converted and illegal additions made. Not economical to repair. It fs recommended that the Public Nuisance be abated by the following: 1. Demolish the two structures marked as Building I and Building 2 on Exhibit A attached hereto, and to reconstruct and repair the Building 3 on said Exhibit A, so as to render the same in compliance with the building regul- ations of the City; that all of the foregoing be accomplished within a period of not to exceed 60 days from the date of adoption of Resolution No. 71-24,. g^^.
