HomeMy WebLinkAbout1971 026 CC RESO1971 026 CC RESO;¢fìèÿRESOLUTION NO. 71-26 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 70-N-107) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code/ proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 1402*i Virginia Avenue particularly described as follows: Licensed Surveyor's Map as per Book 21, Page 48 of Licensed Survey southwest 40 feet of Lot 16. 8558-30-1) c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, as amended, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 90 days from the date here- of, the City manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 1402^5 Virginia Avenue II. ZONING M-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general yard cleanup. IV. INSPECTION REPORTS; 1. LOS ANGELES COUNTY FIRE DEPARTMENT: i No notices of violations have been issued for this property. Sections of the City Fire Code being violated are Section 13.25 and Section 13.26. Recommend removal of all accumu- lations of flammable or combustible waste or rubbish and lock or barricade premises securely. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Violations of Los Angeles County Public Health Code Ordinance Sections 808 and 809. No heat, defective floors, walls, ceilings. Unsanitary sinks and toilet facilities. In process of building. No windows and screens. Recommend abate substandard problem bring dwelling up to code). 3. BALDWIN PARK POLICE DEPARTMENT: Crime report on this property: Incident report 3/20/68 CR68-1132, Stolen vehicle 2/25/70 CR70-0710. All doors and windows to location secured. Unable to view interior of structure. Rear wall of location cracked- Miscellaneous bathroom fixtures about grounds. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does not conform to the present zone nor the general plan. There are future streets planned on or near this property according to the general plan. Violations consist of non-conforming single family residence and garage on property, meter disconnected at 1406 but has been connected from 1402 to above. Recommend raze non-conforming structure and general cleanup. 5. BALDWIN PARK BUILDING DEPARTMENT: Property is still posted. Permit pulled 1/16/70 for repairs to bring to Code. No work done permit cancelled 11/30/70. Note: All requirements to bring front house 1402) to comply with recommc notations have been completed under permit No. 1556 dated 1/14/70. Recommend complete demolition of this rear house.
