HomeMy WebLinkAbout1971 027 CC RESO1971 027 CC RESO;¢fìê RESOLUTION NO. 71-27 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 70-N-108) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 1406 Virginia Avenue more particularly described as follows: Licensed Surveyor's Map as per Book 21, Page 48 of Licensed Survey southwest 61.66 feet of northeast 11.66 feet of Lot 16. 8558-30-2) c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said proeprty, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 90 days from the date here- of, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 1406 Virginia Avenue II. ZONING: M-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general yard cleanup. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: No notices of violation have been issued by the Fire Department on this property. Sections 13.25 and 13.26 are in violation of the city Fire Code. Re- commend remove all accumulations of flammable or combustible waste or rubbish and lock or barricade premises securely. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Sections 808 and 809 of the Los Angeles County Public Health Code are being violated. Missing windows and screens, bathroom has defective floors, walls and fixtures. Questionable gas jet and heater, i-ledroom with defective walls and floors. Defective kitchen floor and unsanitary sink. Leaky water heater. The structure is vacant. Recommend abate substandard problem bring dwelling up to code)• 3. BALDWIN PARK POLICE DEPARTMENT: Crime report on this property: 288 PC, 4/29/68, CR68-1500. It is the opinion of the officer that patrol problems may arise as manager of location is long-hair bearded cyclist. Structure may be a fire hazard with all paint equipment located inside va- cant dwelling. Recommendations: above residence doors secured, S/W window broken but, all others locked and secured. Observed two lights burning in location and numerous painting equipment through- out structure. Outside area clean. 4. BALDWIN PARK PLANNING DEPARTMENT: Structure does not conform to the present code nor to the general plan. There are future streets planned on or near this property according to the general plan. Violations include: non-conforming single family resi- dence and garage, debris and other sundries. Recommend raze structure on property and general cleanup. BALDWIN PARK BUILDING DEPARTMENT: Does not conform to code. Can be made to conform but only at considerable expense not recommended). Damp rot in bathroom walls, floorsi sag, evidence- of termite damage and considerable rot damage* Footings are okay. Romex type wiring is exposed on the porch. Power line to the garage is illegal and hazardous. Laundry waste is draining onto the ground. Floor furnace not in operating condition. Toilet has submerged ball cock. Roof is leaking. There is a record of building violations filed against this prop- erty prior public nuisance)• Estimated present worth of structure, none. Estimated cost to bring structure in compliance with Building Code, about $3/000.00. Recommend demolition. Dwelling i in an M-l zone. Considerable structural damage. Not economically feasible to repair and property is dilapidated and deteriorated. It is recommended that the Public Nuisance be abated by the following 1.
