HomeMy WebLinkAbout1971 034 CC RESO1971 034 CC RESO;¢fìçhRESOL17TION NO, 71-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK GRANTING A ZONE VARIANCE APPLICATION APPLICANT: KELLY; CASE NO. ZV-232; LOCATION: 14616 BALDWIN AVENUE). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Baldwin Park does hereby find, determine and declare, as follows; a) That the owners of certain real property, hereinafter described, have hereto- fore made application for a zone variance to allow a patio to encroach into the side yard area; and b) That the property to which said variance relates is more particularly described as follows: Lot 1 of Tract No. 26629 in the City of Baldwin Park, as per map recorded in Book 693, Pages 45 and 46 of-Maps, in the office of the County Recorder of said County; c) That the said variance matter was heard by the Planning Commission and the same was granted by said Commission upon certain terms and conditions; and d) That a timely appeal was filed, appealing the decision of the Commission to the City Council; and e) That the City Council conducted a duly noticed public hearing upon said matter and based upon the evidence presented at such hearing, applicable staff reports and each member of the Council being familiar with the site, the City Council determined that the facts required by Section 9471 of the Baldwin Park Municipal Code were present and that the variance should be granted, subject to certain terms and conditions as hereinafter set forth. SECTION 2. That the above described zone variance be, and the same hereby is, granted subject to the following terms and conditions: a) Except as otherwise provided, the structure shall conform with all applicable Codes of the City of Baldwin Park, including, but not limited to. SECTION 3. That the City Clerk shall certify the adoption of this Resolution and shall cause a copy hereof to be forwarded to the applicant and to the Secretary of the Planning Commission.
