HomeMy WebLinkAbout1971 049 CC RESO1971 049 CC RESOç/RESOLUTION NO. 71-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ORDERING THE WORK AND ACQUISITION AND INVITING BIDS AND SCALE OF PREVAILING WAGES IN CONNECTION WITH ASSESSMENT DISTRICT WHEREAS, the City Council of the City of Baldwin Park did on the 16th day of December, 1970, adopt its Resolution of Intention No. 70-317 to order the therein described acquisitions, work and improvements to be done and made in connection with Walnut Street Assessment District which Resolution of Intention No. 70-317 was duly and legally published in the time, form and manner as required by' law, shown by the Affidavit of Publication of said Resolution of Intention on file in the office of the City Clerk; arid WHEREAS, after the adoption thereof, notices of the passage of said Resolution of Intention, headed Notice of Improvement" was duly and legally posted in the time, form, manner, locations and number as required by law, as appears from the Affidavit of Pos t ing said notices, on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notices of the adoption of Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention No. 70-317, according to the names and addresses of such owners, as the same appear on the last equalized Assessment roll for taxes prior to the day of such mailing, or as known to the City Clerk of the City of Baldwin Park, which said copies were duly mailed in the time, form and manner as required by law, as appears from the Affidavit f Mailing on file herein; and WHEREAS, said City Council having duly received and considered evidence oral and documentary concerning the jurisdiction facts in this proceeding and concerning the necessity for the contemplated acquisition, work and improvement and the benefits to be derived therefrom, and said City Council having now acquired jurisdiction to order the proposed improvement; SECTION 1. IT IS HEREBY RESOLVED by the City Council of the City of Baldwin Park that the public interest and convenience require the acquis itions and improvement referred to in said Resolution 70-317, and said City Council hereby orders that the acquisition, work and improvement, as set forth and described in said Resolution of Intention No. 70-317, and in the plans and specifications incorporated therein, be done and made; and SECTION 2. BE IT FURTHER RESOLVED that the boundaries of the Assessment District, and the grades to which said work and improvements are to be constructed, shall be those set forth and described in said Resolution of Intention No. 1- BIB] 37831-U01 1971-U02 049-U02 CC-U02 RESO-U02 LI3-U03 FO10488-U03 FO11507-U03 DO19487-U03 C6-U03 RESO-U03 7/24/2003-U04 ROBIN-U04 1971 049 CC RESOç/Resolution No. 71-49 70-317, and in the plans and specifications incorporated therein, reference to which is hereby made for all further particulars. SECTION 3. BE IT FURTHER RESOLVED that the work contemplated under Resolution No. 70-317 be, and the same is hereby ordered to be done under the direction of the Street Superintendent and the materials used shall comply with the specifications and be to the satisfaction of said Street Superintendent, directing that the contract to be entered into for said improvement shall contain provisions to such effect. SECTION 4. BE IT FURTHER RESOLVED that the assessment to be made in said proceedings shall be made and signed by the Superintendent of Streets and SECTION 5. BE IT FURTHER RESOLVED that the City Clerk of the City of Baldwin Park is hereby ordered to give notice inviting sealed bids for the doing of such work in the time, form and manner provided by law; and that the notice thereof heretofore published, as evidenced by affidavits on file, is hereby approved. SECTION 6. BE IT FURTHER RESOLVED by the City Council of the City of Baldwin Park that said City Council, pursuant to the provisions of Section 1773 of the Labor Code, has determined and established the general prevailing rate of per diem wages for each type of craft or workman needed to execute or perform the necessary work or improvement in accordance with the schedule appended hereto and described, Schedule of Per Diem Wage Rates", which said Schedule is hereby adopted herein by reference; and SECTION 7. BE IT FURTHER RESOLVED that said Schedule of Per Diem Wage Rates" be and it is hereby embodied in the Notice Inviting Sealed Bids and all contract documents in connection with said work and improvement hereinabove described. SECTION 8. BE IT FINALLY RESOLVED that the time hereby fixed for receiving sealed proposals or bids for the doing of said work and the making of said improvements herein ordered is the day of 1971, at the hour of M. and said bids will be then publicly opened by the City Clerk and declared in the Council Chambers in the City Hall of the City of Baldwin Park; the City Council will receive and consider such bids at 7:30 P.M. on 1971 at the City Council meeting in said Council Chambers. SECTION 9.
