HomeMy WebLinkAbout1971 075 CC RESO1971 075 CC RESOæÕ RESOLUTION NO. 71-75 A RESOLUTION OF THE CITY COUNCIL OF Till1; CITY OF BALDWIN PARK CONFIRMING CERTAIN REPORTS OF THE SUPERINTENDENT OF STREETS 70-S-21, 33, 39, 41 arid 42) The City Council of the City of Baldwin Park does hereby resolve as follows: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That the City Council of the City of Baldwin Park, pursuant to Section 5870, et seq., of the Streets and Highways Code, commenced proceedings to cause the construction of certain improvements, to wit: curb, gutter, sidewalk and drive approach, as set forth in said Reports of Work; and b) That a public hearing was held on said matters, and there- after said City Council ordered said construction to be accomplished; and c) That sixty 60) days after said order was served, the work had not been completed by the owner or person in possession of the prop- erty, and the Superintendent of Streets caused the work to be done; and d) That the Superintendent of Streets did file with the City Council of the City of Baldwin Park his reports of such work, and a hearing thereon was called by Resolution No. 71-46; and e) That said City Council conducted a noticed hearing to consider any protests or objections to the Reports of the Work; and f) That no protests were made. SECTION 2. That the Reports of Work of the Superintendent of Streets heretofore filed and above described, be and the same is hereby confirmed. SECTION 3. That the cost of the construction, as set forth in said Reports, shall be assessed against the properties herein described, which properties front upon the improvements so constructed. SECTION 4, That if such assessment is not paid within the time permitted by law the same shall constitute a special assessment and lien against the properties therein described, in the amount set forth in said Reports, which lien shall continue until the assessment and al'l interest thereon is paid. SECTION 5. That if the assessment is not paid within the time permitted, the City Clerk shall deliver a Notice of Lien, signed by the Superintendent of Streets, as provided in Section 5891 of the Streets and Highways Code of the State of California, to the County Assessor and Tax Collector, who, in accordance with applicable law, shall collect said assessment, together with all other taxes relating to such property. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution.
