HomeMy WebLinkAbout1971 079 CC RESO1971 079 CC RESOæ²RESOLUTION NO. l 71-7° RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINbiNG AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAM^ ABATED 71-N-4) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows 2 a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 3152 Maine Avenue more particularly described as follows: Lot 38 and 43 of Tract No. 24088. 8555-7-38 & 43) c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a pu'biic nuisance, and that the public interest requires that the same b*' abated; and e) That the staff report s amended relating to this nutter, is hereby approved and adopted by this reference, SECTION 2. That the owners of said property, or others having in interest therein, shall abate said nuisance in the manner set forth in t'i staff report, as approved by this City Council. If such abatement i s not accomplished, as required hereby, within 90 days from the date horo- of, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code, SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as proscrib(<l by the Baldwin Park Municipal Code. LOCATION: 3152 Maine Avenue Lots 38 & 43 II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general cleanup of premises. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: There have been no notices of violations issued. Sections 27.113 Accumulation of combustible waste material, 13,26 vacant buildings shall be secured/ doors, windows etc. anc 13.27 unsafe buildings which constitute a fire hazard. recommend removal of accumulated waste material and secure unsafe buildings, uoc^rding doors and windows. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: House is in process of rebuilding. Side open to the outside elements missing windows, screens and doors. House locked at time of inspection but could see in on side interior walls, floors and ceiling not finished filled with building materials. Rear yard has bricks, rocks, building materials, old sheds, truck engines and trailers. Recommend repair or replace substandard structure to be brought up to present codes) 3. BALDWIN PARK POLICE DEPARTMENT: Crime report on the property is as follows: V-459 PC Burglary, 7-14-67, CR67-2302; V-459 P.C. Burglary, 1-4-68, CR68-0050? 459 P.C. Burglary, 2-17-69, CR69- 0638; 488 P.C. Petty Theft, 7-22-69 CR69-2485; 470 P.C. Forgery, 11-17-70, CR703703/AR70-1656; 242 P.C. Battery, 5-9-70 CR70-1576. Location is a fire hazard, due to wooden structure and numerous piles of lumber stacked inside of location. It is definitely a location that can be used for a juvenile hang out. All windows and doors to be secured with wood, to prevent any further malicious damage to location. All property located within should be removed to prevent possible fire hazard. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does conform to the pres- ent zone and general plan. The following violations exist: relocated structure located on lot in need of rehabilitation, non-conforming shed at rear of lot, no off-street parking, storage of truck and debris. Recommend rehabilitate structure, raze shed, build garage, remove truck and general cleanup of premises. 5. BALDWIN PARK BUILDING DEPARTMENT: Relocation not complete. Recommend rehabilitation and full compliance with requirements on relocation requirements or complete removal. Demolish or rehabilitate structure on Lot Nc. 38 shown in Dictur^s A", B'1, C", 0" and F". 2. Demolish two sheds on Lot No. 43 shown in pictures E", H" and K". 3.
