A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK DENYING AN
APPLICATION FOR A CONDITIONAL USE
PERMIT CASE NO. CP-154; APPLICANT:
ST. STEPHAN BAPTIST CHURCH; LOCATION:
14442 MERGED AVENUE).
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES
RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of
Baldwin Park does hereby find, determine and declare,
as follows:
a) That the owners of certain real
property located at 14442 Merced Avenue,
City of Baldwin Park, County of Lo« Angeles,
State of California, as is more particularly
described in Planning Commission Resolution
No. PC71-4, have heretofore made application
for a conditional use permit to allow the
construction and operation of a church and
appurtenant facilities upon said property;
and
b) That the Commission conducted a
duly noticed public hearing upon said matter
and granted said request, subject to certain
terms and conditions; and
c) That a timely appeal was filed,
appealing the decision of the Commission to
the City Council; and
d) That the City Council conducted a
duly noticed public hearing upon said matter
and based upon the evidence presented, the
Planning Commission's recommendations and
files, determined that to permit the use as
proposed would constitute a nuisance to
surrounding and adjacent properties, and
would not be compatible with present and
future proposed uses located within the
immediate vicinity of said subject property,
and for Chose reasons the said application
should be denied.
SECTION 2. That the above conditional use permit
application be, and the same hereby is, denied.
SECTION 3. That the City Clerk shall certify the
adoption of this Resolution and shall forward a copy hereof
to the Secretary of the Planning Commission and to the
applicant,
ADOPTED AND APPROVED this 7th day of April 1971.
