HomeMy WebLinkAbout1971 126 CC RESO1971 126 CC RESO;¢fìè¶RESOLUTION NO. 71- 126 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A TOBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-10) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises/ and buildings and structures thereon constitute a public nuisance; and b) That the property located at 13315 Garvey Avenue- more particularly described as follows: Tract No. 718 lot commencing south 50053130" east 305.36 feet from most northerly corner of Lot 43 thence south 50°53'30" east 96 feet thence south 39°06'30" west to northwest line of Garvey Avenue thence southwest thereon to omitted portion in Assessor's Map Book. 8551-18-14) 71-N-10) c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq. of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result ot the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 60 days from the date here- of, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 13315 Garvey Avenue II. ZONING: C-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general cleanup of premises. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Notices of violations have not been issued. Section 13.26 of the City Fire Code is being Violated: improperly secured buildings and combustibles in building. Rec- ommend secure building and remove combustibles. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Old business, one large room with deteriorated walls and ceiling interior and exterior) broken windows cind screens, two rest rooms, one locked and the other very unsanitary. Recommend provide sanitary restroom facilities if rest- rooms are to be used by public and repair building to abate substandard and unsafe building. 3. BALDWIN PARK POLICE DEPARTMENT: No report submitted. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does conform to the present zone and general plan. Violations are non-conforming service station and allied use. Recommend raze station, remove trailer and general cleanup of premises. 5. BALDWIN PARK BUILDING DEPARTMENT: There are electrical and plumbing violations and the roof is substandard. Recommend demolition. It is recommended that the Public Nuisance be abated by the following: 1. Demolish abandoned service station 13315 E, Garvey and remove storage tanks. Pictures A" through F") 2. Demolish residential structure and sheds to rear at 13321 E. Garvey. Pictures H" through N") 3. Remove all trash, debris and rubbish from property. NOTE: Harold Simpson Company pulled permits^Eor;the owner April 22, 1971. Nothing has been started as fApfrl 27,, 1971.
