HomeMy WebLinkAbout1971 127 CC RESO1971 127 CC RESO;¢fìè–I RESOLUTION NO. 71- 127 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-ll) THE CITY COUNCIL OF THE CITY OF BALDWIN PA^K DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council-of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 4631 Merced Avenue more particularly described as follows: Lot 99 of Tract No. 4624 except that portion of dedicated street. 8537-19-89) 71-N-ll) c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 60 days from the date here- of, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 4631 Merced Avenue II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general cleanup of premises. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Violations of the City Fire Code are unsafe wiring to rear of building and debris and rubbish on premises. Recommend disconnect wiring and general cleanup of property. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: The main house has no particular problems but the rear portion of property has a substandard shed in need of repair. Recommend abate substandard shed at rear of property. 3. BALDWIN PARK POLICE DEPARTMENT: Crime report is 647f P.C./4242 MC drunk/curfew) 12/2/66 ARJ65-0390. There is a shed open on all sides with chicken wire around it, the shed is wood, very old and rotted/ possibly a fire hazard. The shed is used to house an auto, the property is up for sale and is occupied. Contact should be made by City Hall for the shed is un- sightly. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does conform to the present zone and general plan. Violations are non-conforming sheds and weeds. Recommend raze shed and general cleanup of premises. 5. BALDWIN PARK BUILDING DEPARTMENT: Structure framing on rear building is not to code and roof is in need of repairs. Dwell ing is okay. Recommend removal of rear building. It is recommended that the Public Nuisance be abated by the following: 1. Demolish all sheds to rear of residential structure excluding shed with root cellar.
