RESOLUTION NO. 71-156
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK APPROVING A
CONDITIONAL USE PERMIT LOCATION:
5120 GAYHURST AVENUE; APPLICANT:
MARVIN AND DOROTHY TINKLER; CA^E NO.
CP-155).
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES
RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of
Baldwin Park does hereby find, determine and declare, as
follows:
a) That on the 24th day of March, 1971,
the Planning Commission held a duly noticed
public hearing on an application for a condi-
tional use permit to allow a dog kennel in the
M-l light manufacturing) Zone on certain real
property located at 5120 Gayhurst Avenue, more
particularly described as follows:
Lots 25 and 26 of Tract No. 15308
in the City of Baldwin Park, County
of Los Angeles, State of California,
as per map recorded in Book 334,
pages 49 and 50 of Maps, EXCEPT the
northerly 60 feet of Lot 25 and the
southerly 60 feet of Lot 26;
b) That said application, filed
February 24, 1971, was denied by the Planning
Commission, and thereafter, a timely appeal
was filed, appealing the decision of the
Commission to the City Council; and
c) That the City Council conducted
a duly noticed public hearing on said appeal
and based upon the evidence presented, and
each member of the Council being familiar
with the site, it was determined that the
facts required by Section 9473 of the
Baldwin Park Municipal Code were present,
and the application should be approved.
SECTION 2» That the conditional use permit, above
described, be, and the same hereby is, approved, subject
to the following conditions:
a) That the operation permitted
pursuant to said conditional use permit
shall not be deemed to include the boarding
of, or otherwise caring for, dogs other
than those owned by the applicant; and
b) That the total population of the
kennel shall not exceed the total of fifteen
15) adult Pomeranian dogs at any time; for
the purpose of this condition, adult" dogs
shall mean and include every Pomeranian dog
over the age of three 3) months; and

c) That the applicant shall be deemed
to be engaged in business within the meaning
of the Business License provisions of the
Baldwin Park Municipal Code; and
d) That no signs shall be permitted
on the subject property advertising the
dog kennel operation; and
e) That the applicant shall comply
with all applicable laws including, but not
limited to, the building and zoning regu-
lations as set forth in the Baldwin Park
Municipal Code.
f) That the applicant shall sign an
affidavit within 10) days of the approval
date of this Resolution that he has read
and accepts all conditions of approval for
the Conditional Use Permit.
SECTION 3. That the City Clerk shall certify the
adoption of this Resolution and forward a certified copy
hereof to the applicant and to the Secretary of the
Planning Commission.,
ADOPTED AND APPROVED this 5th day of May
1971.
