HomeMy WebLinkAbout1971 143 CC RESO1971 143 CC RESO;¢fìèGRESOLUTION NO. 71-145 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-21) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 5036 Stewart Avenue more particularly described as follows; Tract No. 10735 west 200 feet of south 65 feet of Lot 7. 8536-2-6) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, consti- tute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abate- ment is not accomplished, as required hereby, within 90 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code, PASSED AND APPROVED this 9th day of May__________, 1971. LOCATION: 5036 Stewart II. ZONING: R-l III, DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general cleanup of premises IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Notices of violation have been issued. Section 27.113 accumulation of waste material is being violated. Large piles of combustible material and junk material and non- operable auto in yard. Recommend remove waste material and junk autos. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Two trucks, one with cast-off appliances, a flat bed truck with a stove/ some lumber and some assorted cast-off materials in front yard. Unable to see rear yard and house interior at time of inspection. Owner not home). Recommend elim- ination of possible rodent harborage. 3. BALDWIN PARK POLICE DEPARTMENT: Crime report for this property; 242 PC Battery) CR71-1232 3/13/71. Location appears to be used for junk storage yard and possibly auto repair or wrecking facility. It would be an attractive nuisance for juveniles. The residents would not come to the door for contact. Recommend officials make contact to determine zoning violations, also that the Los Angeles County Fire Department check location for fire hazards. 4. BALDWIN PARK PLANNING DEPARTMENT: This structure does conform to the present zone and the general plan. Violations are: no paved drive way, two trucks, a trailer, a camper top and a car stored in the front yard, also appears that there is a commercial vehicle parked on premises. Recommend removal of all vehicles from yard area. 5. BALDWIN PARK BUILDING DEPARTMENT: Footings are not to standard, there are electrical and plumbing violations and the roof is in poor condition, This property needs a good cleanup and trash removal. Several trucks and autos are parked in the front yard, It is recommended that the public nuisance be abated by the following: 1.
