Home My WebLink About1971 159 CC RESO1971 159 CC RESO;¢fìèRESOLUTION NO. 71- 159 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-15) 1.1- k THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of th^ Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 4328 Filhurst more particularly described as follows: Lot 12 of Tract No. 14237. 8546-24-16) 71-N-15) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 60 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as,prescribed by the Baldwin Park Municipal Code. LOCATION: 4328 Filhurst Avenue II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Major lot cleanup and removal of all auto parts and debris IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Notices of violations have not been issued. Section 27.113 of the City Fire Code is being violated Rubbish and waste material stacked in front yard. Recommend removal of rubbish and waste material and general clean- up of premises. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Violation of Los Angeles County Public Health Code, Ordinance 7583, Section 628. Front and rear yard has many cast-off articles, trash, debris and household articles. Eliminate possible rodent harborage. 3. BALDWIN PARK POLICE DEPARTMENT: There is no crime report on this property. Recommend four automobile engines laying in front yard and all unsightly auto parts be removed from property. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on the property does conform to the present zone and general plan* Violations consist of old engines and junk cars in rear yard, debris and other sundries* Recommend removal of all debris, junk cars and engines and general cleanup of premises* 5. BALDWIN PARK BUILDING DEPARTMENT: There are no building violations at this property address* Recommend general cleanup of premises. It is recommended that the Public Nuisance be abated by the following 1. Remove all auto parts, junk, trash, debris and weeds. All pictures. Note: Auto Nuisance pending for removal of all vehicles in rear yard.
