HomeMy WebLinkAbout1971 184 CC RESO1971 184 CC RESO;¢fìç“RESOLUTION NO. 71-184 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-34) THE CITY-COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1, That the City Council of the City of Baldwin Park does hereby find/ determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 4926 Bresee Street more particularly described as follows: Lot 130 of Tract No. 26009. 8537-35-4) 71-N-34) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, con- stitute a public nuisance; and d) That as a result of the evidence presented it- said hearing, it was determined that the same does cons.--i.tute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abate- ment is not accomplished, as required hereby, within 60 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 4926 Bresee Street II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general cleanup of premises, IV. INSPECTION REPORTS; 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Weeds just starting to appear, no hazard at this time. Home unlocked and appears to have been vandalized. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Rear yard with trash and debris and large amount of dog droppings. House in bad shape due to vandals/ evidence of fire defective walls, floor and ceilings. Recommend repair and correct substandard dwelling, eliminate trash and debris from interior and exterior to prohibit possi1 rodent and insect infestation. This property has been posted by this department for Human Occupancy. 3. BALDWIN PARK POLICE DEPARTMENT: Location is a one story stucco residence, yards are in poor condition. Doors and windows secure, no indication of malicious mischief or being a hangout for juveniles. Recommend property owner or agent expedite to improve yard conditions and restore the structure to accomodate occupancy 4. BALDWIN PARK PLAITING DEPARTMENT: The structure on this property does conform to the present zone and general plan. Violation of rear yard setback by illegal addition of rear room and patio covering. Violation of side yard setback requirements of five feet on each side of house. Recommend removal of illegal additions or obtain variance to allow encroachment in redr setback, cleanup property and bring'up to code. 5* BALDWIN PAR^ BUILDING DEPARTMENT: Illegal closed-in patio built on to rear of house without ermit. Electrical fixtures missing, illegally installed wiring in patio. Recommend demolition of closed-in pat^-o to provide legal light to dining area and rehabilitate remainder- It is recommended that the Public Nuisance be abated by the followinq: 1. Demolish rear add-on built without building permits or Planning approval of encroachment into rear and side yard set backs.
