HomeMy WebLinkAbout1971 195 CC RESO1971 195 CC RESOéæRESOLUTION NO. 71-195 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-37) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises,,and buildings and structures thereon constitute a public nuisance; and b) That the property located at 4325 Cutler Avenue more particularly described as follows: Lot 52 of Tract No. 14201. 8544-5-18) 71-N-37) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 5 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 4325 Cutler Avenue II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and major lot cleanup. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: * Notices of violations have not been issued. Violations consist of: Section 13.25, failure to remove noxious and combustible waste upon vacating? 13.26 failure to remove accumulations of flammable or combustible rubbish and failure to securely lock, barricade all doors, windows and other openings; 13.27 building constitutes a fire hazard by reason of inadequate maintenance and abandonment; 27.113 accumulation of weeds, litter and combustible waste and rubbish. The building should be declared a public nuisance and should be abated by repair, rehabil- itation, demolition or removal. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Deteriorated floors, walls and ceilings; stopped up kitchen sink very unsanitary conditions throughout the house, house open to public, all household articles still in house, garbage, trash and debris, evidence of cockroaches and flies, broken windows outside high weed growth and weeds. Recommend elimination of roach infestation and fly breeding, remove all cast off household articles, trash debris and garbage, correct structure to meet Building Code and eliminate possible rodent harborage. This property has been posted as unfit for human occupation by this department). 3. BALDWIN PARK POLICE DEPARTMENT: Crime report on this property: Victim John Kirn Lien, 245PC 71-0015, 1/1/71. Obvious signs of juvenile beer parties in garage. Entire house is open and filled with filth and debris. Amounts of human defecation inside house are a definite health hazard. High grass, dry weeds and tall trees make a definite fire hazard and make it impossible to observe any activity in the house from the street. Recommend house should be cleaned inside and out and secured. Grass weeds and trees should be trimmed to alievate the fire hazard. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does conform to the present zone and general plan. Violations consist of: Patio en- croaches approximately three 3) feet into five 5) foot side yard area, existing two car garage converted into a living room. Recommend make patio conform to five 5) foot side yard requirement, Living Room" should be converted back into a garage and property is in desperate need of general cleanup, especially of overgrown weeds and bushes. BALDWIN PARK BUILDING DEPARTMENT: Structure framing on the patio does not conform to code. Illegally constructed patio with overspanned rafters and beams. Garage converted to playroom under County inspection in 1952. Recommend demolition of illegal patio and recon- vert garage to its original use. It is recommended that the Public Nuisance be abated by the following: 1. Demolish patio, pictures C", D", E", F" and G". 2. Demolish shed, picture I". 3. Rehabilitate entire residential house to current code. Pictures A", B", C", D", E", F"/ G" and H". 4. Reconvert garage to it's original use. Picture B". 5. Conduct general lot cleanup, front and rear yards. All pictures.
