HomeMy WebLinkAbout1971 204 CC RESO1971 204 CC RESO8f;¢féÂRESOLUTION NO. 71-20^ RESOLUTION 6F THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OP A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-30) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been. initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 12908 Bess Avenue more particularly described as follows: Lot 32 of Tract No. 10953, except that portion of dedicated street. 8550- 22-25) 71-N-30) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, con- stitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abate- ment is not accomplished, as required hereby, within 90 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 12908 Bess Avenue II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general cleanup of premises. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Notices of violations have not been sent. Section 13.27, unsafe buildings. Section 13.26, vacant buildings and Section 27.119, electrical wiring is being violated. Unsafe due to dilapidated state and abandonment, open and available to juveniles and transients and substandard wiring existing, state of dilapidation. Recommend repair, rehabilitate, demolish or remove. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Vacant house with missing or broken screens and windows. House locked at time of call, could see through windows, defective walls, floors and heater. Exterior of house in poor repair with an addition on rear with defective roof. Garage with some debris and appliances. Recommend abate substandard dwelling by correction, repair or demo-r lition. 3. BALDWIN PARK POLICE DEPARTMENT: No crime report or patrol problems at present. Small amount of scrap lumber in driveway, but yard is free of weeds etc. Structure is secure. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure does conform to the present zone and general plan. There are no apparent zoning violations. Recommend general cleanup and building brought up to code. 5- BALDWIN PARK BUILDING DEPARTMENT: Broken floor members, ceiling members overspanned, exposed romex, broken wires, broken plumbing fixtures, piping and heaters not vented.
