HomeMy WebLinkAbout1971 205 CC RESO1971 205 CC RESO8f;¢fé½RESOLUTION MO. 71- 205 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-43) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq*, of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 13517 Benbow Street more particularly described as follows: Lot 5 of Tract No. 30159. 8537-30-19) 71-N-43) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That aa a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, c.nd that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abate- ment is not accomplished, as required hereby, within 0 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldvrin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 13517 Benbow Street II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard buildings and general cleanup of premises. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Sections 13.27, 1.25, 27.119 and 27.112 of the City Fire Code are being violated. Conditions which are in violation are illegal water heater, Christmas lights nailed to roof, insecure building and elec- trical outlet covers are missing. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: House open and vacant. Outside in general lack of repair, roof and porch especially, two broken windows, missing screens, deteriorated doors and floor cover- ings. Back porch made into a room and not sealed off from outside and is filled with debris. Interior of house in poor repair and very unsanitary. Recommend bring dwelling up to building code standards and gen- eral cleanup of premises. 3. BALDWIN PARK POLICE DEPARTMENT: Easy access into home. Rear door insecure. Possibility of hangout for runaway juveniles and/or transients. Front Gate is left open. Request accesses be boarded up and gates locked. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does conform to the present zone and general plan. Violations are no two car garage and weeds growing on property. Recommend construct a two car garage and remove weeds. 5. BALDWIN PARK BUILDING DEPARTMENT: Structure framing violation but can be made to conform. Recommend remove enclosed storage area on rear of house, properly enclose water heater and cap off unused plumbing, provide proper size material for posts and beam at front porch and provide proper post anchors. It is recommended that the Public Nuisance be abated by the following 1. Rehabilitate structure in accordance with requirements of Building Department. 2.
