HomeMy WebLinkAbout1971 214 CC RESO1971 214 CC RESO;¢fìé•RESOLUTION NO. 71-21^ RESOLTUION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-35) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 13843 Los Angeles Street more particularly described as follows: Lot 14 of Tract No. 4624 except that portion of dedicated street. 8537-25-32) 71-N-35) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council./ If such abate- ment is not accomplished, as required hereby, within days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 13843 Los Angeles Street II. ZONING: R-3 III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general cleanup of premises. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Section 27.113 of the City Fire Code is being violated. Waste materials on premises and probable building code violations. Recommend removal of weeds and waste material and comply with building code. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Single family residence with broken windows, missina screens, deteriorated ceiling in living room and kitchen. Bathroom sink not connected to sewer drain. Outside there is cast- off household articles and trash. There is a substandard shed with trash and debris and the garage is in the same condition. At rear of property there is wood and high weeds. Recommend repair, replace demolish or correct sub- standard dwelling and remove all trash and debris to elim- inate possible rodent harborage. 3. BALDWIN PARK POLICE DEPARTMENT: Crime report: 8/31/69, Louis M. Martinez AR69-1224, 40508-a/1250-a V.C. Dwelling occupied, numerous broken windows, rear shed has broken windows and no doors. Junk vehicle in rear yard, hazard to children. Recommend premises be cleared of junk and windows be replaced. The dwelling appears unsafe for habitation without extensive remodeling. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure does not conform to the present zone and general plan. The gara'-^ is used for storage of furniture and there is no room for car. Car is parked on back lawn. Stucco shed at rear of property, trash scattered around. Property is in need of general cleanup. Recommend clean out existing garage, eliminate substandard shed, remove car from illegal par^i'1^ area and have a'general cleanup of the property. 5. BALDWIN PARK BUILDING DEPARTMENT: Structure framing, footings and roofing are nonconforming and cannot be made to conform to code. Recommend demolition of all substandard sheds. Demolish shed shown in picture E". 2. Demolish substandard garage or rehabilitate. 3. Conduct general lot cleanup including weeds in rear portion of deep lot.
