HomeMy WebLinkAbout1971 221 CC RESO1971 221 CC RESO;¢fìé€RESOLUTION NO. 71- 221 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-46) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance? and b) That the property located at 13175 Emery Avenue more particularly described as follows: Tract No. 8805 that part except that portion of dedicated street outside Baldwin Park County Water District of northwest 60.22 feet of southeast 162.44 feet of southwest 294.34 feet of Lot 52. 8551-2-13) 71-N-46) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 60 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 13175 Emery Avenue II. ZONING: R-l III. DESCRIPTION-AND CONDITION OF PREMISES: Substandard structures and general cleanup of premises. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Notices of violations have been issued. Section 27.113 accumulation of waste material is being violated. Dry grass weeds, and combustible rubbish on premises. An FD 410 official inspection report has been issued. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Old substandard shed, high weed growth, a few cast-off articles and some lumber on ground. Main dwelling showed no health violations. Recommend eliminate possible rodent harborage. 3. BALDWIN PARK POLICE DEPARTMENT: No visible problems. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does conform to the present zone and general plan. A future street Egil Avenue) is planned at rear of property. Recommendations are provide a garage, remove non-accessary storage shack and remove all weeds. 5. BALDWIN PARK BUILDING DEPARTMENT: Structure framing, footings and roofing does not conform to code. Substandard shed at rear of property is built too close to property line. Demolish same, clean weeds, trash, debris and rubbish from property. It is reconmended that the Public Nuisance be abated by the following: 1. Demolish shed at rear of property^ which is substandard hv on- croaching into side yard set back. Pictures A", B", C" and D". 2. Conduct general lot cleanup including weeds. Pictures E" and F".
