HomeMy WebLinkAbout1971 224 CC RESO1971 224 CC RESO;¢fìétRESOLUTION NO. 71-224 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ENDORSING STATE WIDE APPORTIONMENT OF SALES AND USE TAXES ON THE BASIS OF POPULATION AND OPPOSING THE MANNER OF DISTRIBUTION PRESCRIBED BY THE BRADLEY- BURNS UNIFORM LOCAL SALES AND USE TAX LAN WHEREAS, distribution of sales and use taxes collected, under the Bradley-Bums Uniform Local Sales and Use Tax Law Is made according to the location at which the sale or use occurred; and WHEREAS, such distribution Is entirely disproportionate and unrelated to the fiscal needs of the governmental agency receiving distribution; and WHEREAS, the result of such distribution Is that the consumer against whom such tax Is levied does not receive the benefit of such tax, but the residents of municipalities which strive to provide a balanced community con- sisting of both commercial and residential uses are compelled to pay taxes which accrue to the benefit of municipalities which restrict, or In some cases altogether eliminate residential development In favor of commercial develop- ments Example: The City of Vernon. California, with 229 residents, receives tax revenue of $3,214,177); and WHEREAS, those municipalities which provide a balanced community for their residents and merchants necessarily Incur proportionately higher expenses for police, fire, and other municipal services; and WHEREAS, the City Council of the City of Baldwin Park deplores the current taxation of the many for the benefit of a few. NOW. THEREFORE, be it resolved by the City Council of the City of Baldwin Park that it endorses the concept of apportionment of sales and use taxes among municipalities on the basis of the population residing within each municipality and advocates the repeal or amendment of the provisions of the Bradley-Burns Uniform Local Sales and Use Tax Law insofar as it establishes the Inequitable distribution on the basis of the location of sales or use. RESOLVED. FURTHER, that the City Council of the City of Baldwin Park urges that the City Council of each California city express Its opposition to the current manner of distribution of sales and use taxes by the adoption of a resolution which expresses their position and urges the Immediate enaction of legislation to correct the Inequity described above* PASSED AND ADOPTED this 1st day Of September 1971.
