HomeMy WebLinkAbout1971 228 CC RESO1971 228 CC RESO;¢fìé]RESOLUTION NO. 71- 228 RESOLUTION OP THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-45) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 12848 Salisbury Street more particularly described as follows: Rancho La Puente 0*31 more or less acre commencing at northeast corner of Lot 13 Tract NO. 29418 thence south 75°52' east 50 feet with a uni- form depth of 270 feet south 14°08' west. 8550-26-17) 71-N-45) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 60 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 12848 Salisbury Street II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general cleanup of premises. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Sections of the City Fire Code being violated are: 27•113 accumulation of waste material, 13.25 vacating premises and 13.26 vacant buildings. Recommend abate all hazards by removal. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Vacant house with missing screens and broken windows; front and rear porch areas enclosed into rooms not sealed off from elements at wall and ceiling also flooring. Rear of property has old trailers and cast off articles and high weed growth. Recoil—end elimination of possible rodent harborage and insect breeding, abate substandard dwelling and clear premises of all weeds, trash and debris. This dwelling has been posted as unfit for human occupancy by this department. 3. BALDWIN PARK POLICE DEPARTMENT: Crime report on this property: 7/14/67 459 P.C. Suspect); 11/22/68 273d PC Suspect); 7/8/68 488 PC Victim)? 9/11/69 5 Recovered vehicles CR#69-3108, 3109, 3110, 3111, 3112. Vacant house condemned by County) all doors and windows secured at this time. Two empty vehicles in back yard j visible from street), one house trailer empty) and one truck body. High weeds in back yard. Reconmend vehicles be moved from location and weeds be cut to alleviate fire hazard. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure does conform to the present zone and general plan. Recoonend provide paved driveway and two car garage, Remove all brush, weeds, junk, vehicles and fence which is over 6 feet tall. Comply with all side yard setback re-^ quirements. House appears to be substandard, consideration as to demolition should be given. 5. BALDWIN PARK BUILDING DEPARTMENT: Ceiling too low in room at front which was originally a porch. Return area to its original use and remove all wiring. Remove all exposed wiring, provide new electrical service. Repair shower to make waterproof. Remove all non-conforming additions and bring main structure up to minimum standards of building, electrical and plumbing codes. 2. Demolish all other structures on property. Pictures G" and H". 3.
