HomeMy WebLinkAbout1971 229 CC RESO1971 229 CC RESO;¢fìéW RESOLUTION NO. 71- 229 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-48) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwi Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 4318 North Maine more particularly described as follows: Lot co—encing south 40 feet and east 162.32 feet and south 393.89 feet from north- west corner of Section 17 Township 1, South Range 10 west thence south 50 feet thence north 89057> west to easterly line of Maine Avenue thence north thereon 50 feet thence south 89057t east 122.32 feet to beginning part of Lot 4 in Section 17. 8437-1-13) 71-N-48) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the vwners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement i?s not accomplished, as required hereby, within 90 days from the date hereof, he City Manager shall abate the same, as provided in Section 3208 et 3eq«, of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION; 4318 North Maine II. ZONING: C-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general cleanup of premises. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Sections of the City Fire Code being violated are 27.113 accumulation of waste material, 13.26 vacant buildings, 13.27 unsafe buildings. Recommend remove all combustible rubbish inside and out and structure be abated by repair, rehabilitation, demolition or removal. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Rear and front yard filled with cast-off household articles, clothing, garbage, trash and debris. Missing screens, deteriorated floors, walls and ceilings, very unsanitary. House in general lack of repair and maintenance. Recommend abate substandard dwelling by repair, reconstruction or demolition, eliminate rodent and insect harborage and breeding. This dwelling has been posted by this depart- ment as unfit for human occupancy. 3. BALDWIN PARK POLICE DEPARTMENT: Location appears secured, however, due to depth of rear yard and location of rear building is a patrol problem. Recommend that outside front and rear yards be cleaned as trash and clothing could cause health problem. In- terior of residence needs cleaning. House gives appear- ance of being an eyesore, health problem and possibly a patrol problem. 4. BALDWIN PARK PLANNING DEPARTMENT Property is in desperate need of cleanup, a two car garage and a fully paved driveway. Eliminate encroachments of building and patio into side yard setback. Building is blighted and appears to be substandard. Reco—end lition. 5. BALDWIN PARK BUILDING DEPARTMENT: Patio addition not built to Uniform Building Code standard, wiring and plumbing need repairs and building is in C-l zone and is being used for a single residence. Recommend removal by demolition.
