HomeMy WebLinkAbout1971 235 CC RESO1971 235 CC RESO;¢fìéDRESOLUTION NO. 71-235 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-52) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 4000-04 Walnut Street more particularly described as follows: Valley View Acres south 132 feet of Lot 29. 8546-31-21) 71-N-52) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, con- stitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abate- ment is not accomplished, as required hereby, within 60 days Ifrom the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 4000-04 Walnut Street II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general cleanup of premises. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Sections of the City fire code being violated are: 13.25, 13.26, 13.27 and 27.113 ie., accumulation of waste materials, vacating premises, vacant building and unsafe buildings. Recommend removal of waste materials, buildings to be abated by repair, rehabilitation, demolition or removal in accordance with the fire code. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Both dwellings are vacant and in general lack of repair and maintenance. Broken windows and missing screens, deteriorated walls, floors and ceilings. Heavy infestation of cockroaches with garbage, trash and debris inside and outside of buildings. The heater and sanitary facilities are defective. These dwellings have been posted by this department as unfit for human occupancy. Recommend abate the substandard condition by repair, correction, reconstruction or demolition and general cleanup of premises. 3. BALDWIN PARK POLICE DEPARTMENT: Crime Report for this property: 7/10/68 stolen auto, 12/68 487.3 P.C., 4/19/69 148.5 P.C., 4/7/70 5150 W.I.C., 7/9/70 44a P.C. Both locations are hazards to juveniles as windows are broken and entry is possible. Extreme fire hazards. Both yards overgrown with weeds. Recommend both houses should be knocked down. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does conform to the present zone and general plan. There is a future street planned at the rear of this property. Violations are: No paved driveway at 4000 Walnut also no two car garage, appears that there are illegal room additions. At 4004 Walnut there is storage of wood and junk in garage and it encroaches into side yard setback. Both houses are a blight, eyesore, nuisance and a definite fire and health hazard. Property should be cleaned up and both houses demolished immediately* 5. BALDWIN PARK BUILDING DEPARTMENT: There are numerous violations by these structures. Recommend demolition of both structures. 4000 Walnut has inadequate foundations and the wood is too close tc ground in both buildings. Demolish all buildings on this property in all pictures. 2. Remove all vehicles from premises. 3. Complete lot cleanup.
