A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK DECLARING
ITS INTENTION TO CONDUCT A PUBLIC
HEARING FOR THE PURPOSE OF DETERMINING
WHETHER CERTAIN IMPROVEMENTS CONSTRUCTED
AND FINANCED PURSUANT TO A SPECIAL
ASSESSMENT DISTRICT PROCEEDING SHOULD
BE SOLD VIRGINIA AVENUE ASSESSMENT
DISTRICT).
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES
RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of
Baldwin Park does hereby find, determine and declare,
as follows:
a) That the City Council of the City
of Baldwin Park, pursuant to applicable
provisions of the Municipal Improvement Act
of 1911, has heretofore established a special
assessment district and constructed certain
improvement^ therein, the said district
being known as the Virginia Avenue Assess*
merit District; and
b) That among other improvements
constructed as a part of said Assessment
District were water mains, pipes, conduits,
hydrants and other works or appliances
proposed to be used to supply water to
properties within the said District
boundaries hereafter facilities"); and
c) That at the time of the hearing,
held for the purpose of considering the
formation of said District, and at the
subsequent hearing, held for the purpose
of spreading the assessments'against
properties located within the boundaries
of said District, the City Council indicated
that it intended to consider the sale of the
said facilities constructed as a part of
said District to the San Gabriel Valley
Water Company, a public utility; and
d) That in furtherance of its
intention to sell the said facilities to
the said San Gabriel Valley Water Company,
the City Council made a contribution of
funds to the District from its General
Fund, in an amount equal to the cost of
the said facilities; and
e) That the reason for the proposed
sale of said water service improvements is
that the City does not operate a water system
as a municipal function and a full study and
investigation was made concerning the

best method to be utilized to supply
domestic water to properties within the
boundaries of said District, and the con-
clusion reached based upon said study,
was that sale should be made to the San
Gabriel Valley Water Company since that
said Company is a public utility and the
properties included within the District
are entirely within the service area of
said San Gabriel Valley Water Company;
and
f) That the public interest, c6n-
venience and necessity requires that the
City Council conduct a duly noticed public
hearing to consider whether or not the sale
of said improvements, above described.
should be made to the said San Gabriel
Valley Water Company, without requiring
competitive bidding for the proposed sale.
SECTION 2. That notice is hereby given that on
November 3, 1971, in the Council Chambers of the City Hall
at 14403 E. Pacific Avenue, Baldwin Park, California, at
the hour of 7:30 P.M., or as soon thereafter as the matter
can be heard, that the City Council will conduct a duly
noticed public hearing to determine whether or not the said
water facilities, above described, should be sold, and if
the same are to be sold, whether the same should be sold to
the San Gabriel Valley Water Company for the reasons above
set forth. Any person who is the owner of any real property
included within the boundaries of said Assessment District
may appear at said hearing for the purpose of objecting to
the sale of said improvements.
SECTION 3. That the City Clerk is hereby directed to
cause this Resolution to be published once a week for two
2) successive weeks in the Baldwin Park Bulletin, an
adjudicated newspaper of general circulation within the
City of Baldwin Park.
SECTION 4. That the City Clerk shall certify the
adoption hereof and cause the same to be published in the
manner hereinabove described.
