HomeMy WebLinkAbout1971 245 CC RESO1971 245 CC RESO;¢fìéRESOLUTION NO. 71-245 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OP A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-55) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows; a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 1366 North Maine Avenue more particularly described as follows: Lot 19 of Tract No. 11474. 8559-2-10) 71-N-55) * c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, consti- tute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abate- ment is not accomplished, as required hereby, within 30 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 1366 N. Maine Avenue II. ZONING: R-3 III. DESCRIPTION AND CONDITION OF PREMISES: Substandard structures, illegally parked autos, auto parts and general cleanup of premises. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Sections of the City Fire Code being violated are: 27.113, accumulation of waste material, 13.27, unsafe building, 13.26, vacating premises without removing fire hazards and abandoned vehicles. Recommend rehabilitation, demolition or removal. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: I 1 Several vehicles parked on property also auto parts,, tires and cast-off materials throughout the premises. Old house appears to be all right but an old low shed addition was lacking maintenance. Recommend possible rodent harborage. 3. BALDWIN PARK POLICE DEPARTMENT: Crime report for this property: 5/25/69, 4242 M.C. 647 F P.C 6/26/70, 459 PC 487.3 PC, 1/23/71, Petty theft. There are nine 9) vehicles parked in the front yard, miscellaneous auto parts and other junk items laying around. Could be considered an eye sore due to excess rubbish. Recommend location should be cleaned up and junked autos disposed of. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does not conform to the present zone nor the general plan. R-l use in R-3 zone) There is no garage or paved driveways. There are nine 9) vehicles parked in front yard. Junk laying around side of house. Weeds, trash, debris and papers on property. Recommend install paved driveways and garages, remove all vehicles and major lot cleanup. 5. BALDWIN PARK BUILDING DEPARTMENT: Structure framing, electrical and plumbing do not conform to code. This property was posted in 1966. Note on Building Permit issued March 20, 1967 required bedroom addition be removed in two 2) years. Recommend remove all non-conforming additions to the dwelling and correct all code deficiencies or demolish completely.
