HomeMy WebLinkAbout1971 246 CC RESO1971 246 CC RESO;¢fìéRESOLUTION NO. 71-246 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-57) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and^ b) That the property located at 3548 Patritti Avenue more particularly described as follows: Lot 16 of Tract No. 15148. 8550-9-16) 71-N-57) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, consti- tute a public nuisance; and d) That as a result of the evidence presented at said hearing,, it was determined that the same does consti- tute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council* If such abate- ment is not accomplished, as required hereby, lirithin 60 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as pres- cribed by the Baldwin Park Municipal Code. LOCATION: 3548 Patritti Avenue II. ZONING: R-l III. DESCRIPTION AND CONDITION OP PREMISES: Substandard structures and general cleanup of premises. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Sections of the City Fire Code being violated are: 13.25 vacating premises all noxious and hazardous materials to be removed, 13.26, vacant building must be secured and 27.113, remove weeds and waste material from property. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: House vacant and open. Trash, garbage, debris, old furniture and lumber on rear yard. House has broken windows and missing screens, very unsanitary throughout. General deteriorated condition in kitchen, bathroom and bedrooms. Recommend eliminate insect infestation and abate substandard dwelling. This property posted as unsafe for human occupancy by this department. 3. BALDWIN PARK POLICE DEPARTMENT: Crime report for this property: 1/14/70 459P.C. Barger, Darrel Aroes. Location is a vacant, one family residence not fit for human habitation for reasons of broken windows lack of light, gas and water. Filth and danger from fire or injury from trash and debris throughout home and yard. Location is an attractive nuisance for juveniles to use as a gathering place. Neighbor, Clarence Hartman of 3545 Patritti stated juveniles gather at the location all hours of day and night. Recommend the location be re- stored to a state fit for human habitation or destroyed as a danger to public safety. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does conform to the present zone and general plan. Carport exists, needs either two car garage or two car carport. Recommend clean up property, remove trash and repair fences. 5. BALDWIN PARK BUILDING DEPARTMENT: There are structure framing, electrical and plumbing violations at this property. Recommend rehabilitate and general cleanup of premises.
