HomeMy WebLinkAbout1971 247 CC RESO1971 247 CC RESO;¢fìéRESOLUTION NO. 71- 247 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-58) 4 r * i THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 3572 Patritti Avenue more particularly described as follows; Lot 21 of Tract No. 15148. 8550-9-21) 71-N-58) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, consti- tute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does consti- tute a public nuisance, and that the public interest re- quires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abate- ment is not accomplished, as required hereby, within 60 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as pres- cribed by the Baldwin Park Municipal Code. LOCATION: 3572 Patritti Avenue II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES; Substandard structures and major lot cleanup IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Sections of the City Fire Code being violated are: 13.25, vacating premises all noxious and hazardous materials to be removed, 13.26, vacant building must be secured, 27.113, remove weeds and waste materials from property. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: House is open and vacant. Front porch has old couch, broken windows and trash. Entire house is in deteriorated condition having trash, debris and cast-off materials all over. Animal droppings on many floors. Deteriorated old shed in rear. Recommend eliminate possible rodent infestation and harbor- age, remove all trash and debris and abate substandard dwelling. This property posted as unsafe for human occupancy by this department. 3. BALDWIN PARK POLICE DEPARTMENT: Location is a vacant one family dwelling not fit for human habitation no gas, electricity, water? walls broken down, fixtures missing, all windows broken and trash strewn about. There is evidence of fires being set in- side. Evidence indicates the location is a gathering place for juveniles. Recommend the location be restored to a state fit for human habitation or destroyed as a danger to public safety. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this lot conforms to the present zone and general plan. The garage appears to be formerly used as a living quarter. Recommend cleanup of property, restore garage use to car storage and repair rear cement building roof. 5. BALDWIN PARK BUILDING DEPARTMENT: Substandard shed in rear to be demolished, add one hour fire wall in garage, repair heating, electrical and plumbing in house. It is recommended that the Public Nuisance be abated by the following; 1. Demolish shed shown in pictures I", j" and K".
