HomeMy WebLinkAbout1971 277 CC RESO1971 277 CC RESO(ÌìüJRESOLUTION BO. 71- 277 RESOLUTION OP THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SANE ABATED 71-N-61) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That: the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 3770 Baldwin Park Boulevard wore particularly described as follows: Rancho La Puente lot except that portion of dedicated street ciirnncing south 41°53' west 56.875 feet froR most westerly corner of Lot 2 Tract No. 3889 thence south 41°53' west 56.875 feet with a uniform depth of 204.16 feet south 48 07' east. 8553-16-3) 71-N-61) c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was deter»ined that the saws does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this Ratter, is hereby approved and adopted by this reference. SECTION 2. That the owners of. said property, or others having an interest therein, shall abate said nuisance in the anner set forth in the staff report, as approved by this City Council. If such abate- ment is not accomplished, as required hereby, within fin days froa the date hereof, the City Manager shall abate the saae, as provided in Section 3208 et seq. of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as pres- cribed by the Baldwin Park Municipal Code. LOCATION: 3770 Baldwin Park Boulevard II. ZONING: R-l III. DESCRIPTION AND CONDITION OP PREMISES: Substandard structures and general cleanup of premises. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: No notices of violations have been issued. Sections being violated are: 13.25, vacant premises and vacant buildings and 27.113, accumulation of waste material Building must be secured and all noxious and hazardous materials must be removed from inside and outside of building. 2. UOG ANGELES COUNTY HEALTH DEPARTMENT: Sections of Health Code being violated are: 803, 808, 809, 828 and 628. House is vacant and open. Yard, front and back, scattered with trash, debris and tree clippings. Old garage in very deteriorated condition filled with trash and debris. House has defective or missing screens in a state of disrepair. Inside defective walls, floors and ceilings. Bath- room has no lavatory, very unsanitary as well as the kitchen. Heavy cockroach investation. Household article and debris everywhere. Eliminate all trash and debris and cockroach breeding and harborage. Abate substandard dwelling by repair, reconstruction or demolition. 3. BAUJNIN PARK POLICE DEPAOTMENT: Crime report against this property 10/22/70. House sets back, is good juvenile hangout, insecure, fire hazard and health problem. Should be considered that premises are demolished. Definite police problem and extreme fire trap. 4. BALDWIN PARK PLA1WIWG DEPARTMENT: Structure does conform to present code, does conform to general plan and there are no future streets planned on or near this property- Violations include, no paved driveways and no carport or garage. Recommem construct driveway and carport or garage.
