HomeMy WebLinkAbout1971 278 CC RESO1971 278 CC RESO(ÌìüPRESOLUTION NO. 71- 278 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THB SAME ABATED 71-N-67) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS; SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 13226 Ramona Boulevard more particularly described as follows; Tract No. 8805 southwest'20 feet of Lot: 29 and northeast 40 feet of Lot 30. 8552-4-23) 71-N-67) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated, and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference, SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within CQ days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 13226 Ramona Boulevard II. ZONING: C-2 III. DESCRIPTION AND CONDITION OF PRQ1ISES: Substandard structures and general cleanup of premises. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: No notices of violations have been issued. Sections being violated are: 27.113, accumulation of waste material, and 13.27, unsafe building. Dry flammable weeds at rear of property. Unsafe building due to inadequate maintenance, dilapidation and abandonment. Due to the dilapidated state of the structure, a fire hazard now exists. To eliminate this hazard, it is recommended the building be demolished. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT; Sections of the Health Code beinc^ violated are: 628, 803, 808, 809, 828; ordinance 7583. House is in very unsanitary condition, kitchen with defective drain- beards, sink, floor coverings and walls. Heavy roach infestation from dining area. Bathtub exposed and draining onto ground under house. In general all walls, floors, and ceilings very dirty and in a state of disrepair Living room has unvented gas line. Bathroom not vented to outside. Very deteriorated. Some trash and debris inside and out. Broken windows and screens. Old shed on rear of premises. There is moderate fly control. Abate substandard dwelling. Remove all possible rodent harborage and eliminate cockroach infestation. This dwelling has been posted as unsafe for human occupancy by this department. 3. BALDWIN PARK POLICE DEPARTMENT: Crime report against this property March 2, 1970. The house cannot be secured, due to broken windows and no door on the rear. This is a juvenile attraction and may prove harmful due to the broken glass. The grass around the house has dried and is a fire hazard. Reconmend that the house be iflmediately boarded up to prevent entry and that the fire department be notified to conduct a fire inspection. 4. BALDWIN PARK PLANNING DEPARTMENT: Structure does not conform to present code, does not conform to general plan. There are no future streets planned on or near this property. Violations include: no paved driveway or garage, unconpleted roo» addition, apparently unsafe shed to rear. House is a blight and appears to be dilapidated. Renove house. BALDWIN PARK BUILDING DEPARTMENT: Structure, footings, electrical, plumbing, and roofing does not conform to code. There is no record of any building violations filed against this property. We have received complaints from the Health Department numerous times. This building is substandard. Has two illegal additions on the rear and illegal plumbing and electrical work. Recommend demolition. It is recommended that the Public Nuisance be abated by the following: 1. Rehabilitata or demolish. 2. Conduct general lot cleanup, including weeds.
