HomeMy WebLinkAbout1972 004 CC RESO1972 004 CC RESO(ÌìücRESOLUTION NO. 72-4 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-62) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 13734 Ramona Boulevard more particulary described as follows: Lots 19 and 20 of Tract No. 8352. 8552-15-19) 71-N-62) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 30 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 13734 Ramona Boulevard II. ZONING: C-2 III. DESCRIPTION AND CONDITION OF PREMISES Substandard structures and general cleanup of premises. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: No notices of violations have been issued. Sections being violated are: 13.25, vacant premised and vacant buildings and 13*27, unsafe buildings, and accumulation of trash and weeds. Unsafe structures constitute a a fire hazard and are hazardous to human because of inadaquate maintenance. Remove all combustible trash and weeds. Unsafe buildings to be abated by repair, rehabilatation, or demolition. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Sections of Health Code being violated are: 7583. Vacant commercial building- old Frostie Restaurant building locked and boarded up but not secured. Defective walls, floors and ceilings and broken equipment inside. Broken windows and screens. Rear parking area has high weed growth. Eliminate possible rodent harborage. 3. BALDWIN PARK POLICE DEPARTMENT: Crime reports on this property on September 6, 1966, 487.2 P. C.) August 13, 1966, 211 P.C.) and January 2, 1969 594 P. C.). All windows in the location have been broken and boarded up. The location serves as an attraction point for juveniles gathering and malicious mischief* Location is a closed, vacant Foster Freeze. The building is a danger to public safety because of broken glass in and about the location, and it appears to be a fire hazard. The location should be repaired or destroyed. 4. BALDWIN PARK PLANNING DEPARTMENT: Structure does conform to present code, does conform to general plan and there are no future streets planned on or near this property.
