HomeMy WebLinkAbout1972 005 CC RESO1972 005 CC RESO(ÌìükRESOLUTION NO. 72-5 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DETERMINING THE EXISTANCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 71-N-63) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS:- SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 13740 Ramona Boulevard more particularly described as follows: Lot 22 of Tract No. 8352 8552-15-20). c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq«, of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 30 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City;CHerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: No notices of violations have been issued. Sections being violated are: 13.25, vacating premises, and 13.27, unsafe buildings, and accumulation of trash and weeds. Unsafe structures constitute a fire hazard and are hazardous to humans because of inadaquate maintenance. Remove all combustible trash and weeds. Unsafe buildings to be abated by repair rehabilatation, or demolition. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Sections of Health Code being violated are: 7583, 628. Vacant commercial building old beauty shop locked and boarded up with broken windows and missing screens. Inside has old equipment in defective condition. Building is vacant, fillminate possible rodent harborage. 3. BALDWIN PARK POLICE DEPARTMENT; Crime report against this property on October 16, 1969 459 P.C.). All windows in the location have been boarded up due to breakage. The location is an attraction point for juveniles for gathering and malicious mischief. The location is a closed and vacant beauty shop. The building is a danger to public safety because of fire hazard and broken glass in and about the location. The location should be repaired or destroyed. 4. BALDWIN PARK PLANNING DEPARTMENT; Structure does conform to present code, does conform to general plan and there are no. future streets planned on or near this property. Buildings are boarded up and are in a deteriorating condition- Clean up property, remove all glass and weeds. Section 9612-B-2) 5. BALDWIN PARK BUILDING DEPARTMENT: Structure framing does conform to codA as do the footings. Electrical, plumbing and roofing does not conform to code, but can be made to conform. Recommend rehabilitate or demolish this vacant srclal building. Within 30 days, secure, in a manner reasonably acceptable to the City Manaqer, and repaint the buildings; 2. If so secured, no occupancy shall be permitted until rehabilitated to conform to all applicable codes of the City; or 3. If not so secured, demolish all buildings and structures; and 4. Conduct general lot cleanup, including, but not limited to weeds.
