HomeMy WebLinkAbout1972 030 CC RESO1972 030 CC RESO(ÌìýÝÔÏRESOLUTION NO. 72-30 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 72-N-l) i THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS; SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 5006 Eiton Street aore particularly described as follows: Lot commencing North 89°57'30" West 232 feet from Southeast corner of East one half of West one half of Northwest one quarter of Northeast one quarter of Section 8, Township 1 South Range 10 West thence Korth 0 45'02" East 105 feet thence North 89 57'30" West 7^.07 more of less feet omitted portion in assessors map book one quarter of Lot 8. 8413-11-13) 72-N-l) \ c) That a duly noticed public hearing having be^n conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference* SECTION 2. That the owners of said property, or others having an interest therein, shall abate: said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abate- ment is not accomplished, as required hereby, within 60 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of the Resolution and cause copies hereof fo be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 5006 Eiton II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES Substandard structures and general lot cleanup. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Section 3250, Ordinance 500 and 368 are being violated ie. vacantr substandard building, debris and combustibles on property. Reconaend clear the property. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT Health Code Ordinance being violated is 7583, Section 628, 543, and 817. Bouse is vacant and locked. Debris and cast-off materials in front yard. Two old sheds and a wooden frame in yard. One is an old bathroom with questionable wiring, no drain for water faucets, toilet very unsanitary and not working. Deteriorated walls, floors and ceilings. Recommend remove outside water closet and substandard structures. Eliminate possible rodent harborage. 3. BALDWIN PARK POLICE DEPARTMENT Crime report on this property: 02-05-71 647 f) PC Warrant Arrest S; Roper, Edwin Albert. All structures at the location are insecure and appear to have been used as a gathering place for juveniles and other unauthorized persons. There Is also a great deal of broken glass which presents a danger to small children. Race—end the owner be contacted and made to secure all structures and clean up all the trash and broken glass. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does conform to the present zone and general plan. Violations of the ir'ng Ordinance include no paved driveway or garage, and improper yard setback. Renj——iiil deaolition of all structures on property and complete yard cleanup. 5. BALDWIN PARK BOILDXNG DEPARTMENT Framing is in poor condition. Electrical and plumbing violations. Bunj—umi desK>lition of all structures on property as the cost of rehabilitation is above the value of the structures. It is reoo—ended that the Public Nuisance be abated by the following: 1. Due to conditions of all buildings on this lot, conduct full demolition or rehabilitation as directed by the Building Department. 2. Conduct complete lot clean up. 3. Rehabilitation or demolition of shwf? sunshade.
