HomeMy WebLinkAbout1972 031 CC RESO1972 031 CC RESO(ÌìýãÔÏRESOLUTION NO. 72- 31 RESOLUTION OP THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 72-N-3) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council-of the City-of Baldwin Park does hereby find, determine and declare as follows: f a) That pursuant to Section 3200 et seq., of t-ie Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures constitute a public nuisance; and b) That the property located at 14864 Pacific Avenue more particularly described as follows: Tract No. 962 Lot on Southwest line of Pacific Avenue per CF1322 commencing Southeast thereon 130 feet from Northwest line of Lot 126 thence Southeast on said Southwest line 100 feet with a uniform depth of 239.1 feet South 41°56'15" West part of Lot 126. 8438-22-62) 72-N-3) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the_.public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abate- ment is not accomplished, as required hereby, within 60 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. t SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 14864 Pacific II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES Substandard structures and general lot cleanup. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Ordinance number 500 and 368, Section 3250 are being violated. Notice FD-410 has been issued.for unsecured, vacant building, substandard building and weeds and combustibles. Recommend the property be cleared. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Sections of the Health Code being violated are: 803, 808, 809, 826, 628 ie. trash and debris, cast off building material, windows and screens broken or missifng,^ unsanitary bathroom, walls, floors and ceiling dirty, bare electrical outlets, high weed growth in rear yard. Recommend eliminate substandard conditions and possible rodent harborac/e. 3. BALDWIN PARK POLICE DEPARTMENT: Crime reports on this property are: 459 PC CR66-1891 06-28-66 V: Smith, Walter Lawson, and 488 PC CR70-2864 08-11-70 V: York, Dennis Keith. The house cannot be secured due to the windows being broken. There are large pieces of broken glass which are causing a safety hazard to juveniles who pass the house while enroute to school. The lawn is dry and there are several piles of dried wood around the area causing a fire hazard. Recommend the house be boarded up to prevent entry and that the Fire Department be notified to make a fire inspection. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does conform to the present zone and general plan. There is no paved driveway. House, garage, and surrounding area in blighted condition. Accumulation of junk storage in yard. Recommend house be demolished. 5. BALDWIN PARK BUILDING DEPARTMENT: Framing, footings, and roofing does conform to code. Electrical and plumbing fixtures cannot be inspected because the house is locked* Recommend complete clean up and repair to meet code requirements. It is recommended that the Public Nuisance be abated by the following: 1. Demolish or rehabilitate residential structure and garage in pictures A, B, C, D, E, and F, 2. Demolish shed at rear of garage in picture F- 3. Demolish sun shade in picture G.
