HomeMy WebLinkAbout1972 032 CC RESO1972 032 CC RESO(ÌìýéÔÏRESOLUTION NO. 72-32 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AMD DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 72-N-4) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 4241 Walnut Street more particularly described as follows: Tract No. 11543 Lot 14. 8546-27-15) 72-N-4) c) That a duly noticed public hearing having veen conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City douncil. If such abate- ment is not accomplished, as required hereby, within 60___days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of the Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 4241 Walnut II. ZONING: R-l III. DESCRIPTION AND CONDITION OF PREMISES Substandard structures and general lot cleanup. IV. INSPECTION REPORTS: 1. LOS ANGELES COUNTY FIRE DEPARTMENT: Sections of the City Fire Code being violated are: 13.25, failure to leave premises in clean, neat condition, 13.26, failure to remove flammable and combustible waste and rubbish, failure to securely lock or barricade out buildings, 13.2^ Delapidated state and inadequate maintenance; 27.113, Accumulation of waste paper, rubbish, old mattresses, inoperative vehicle and tree trimmings strewn over premises. Recoimaend repair, rehabilitation, demolition or removal. 2. LOS ANGELES COUNTY HEALTH DEPARTMENT: Sections of the Health Code being violated are: Ordinance 7583, sections 628, & 319. Leaking water line, old bird cages with droppings, mattresses an-d debris. Several truck tires,- aad tree clippings in the yard. Stopped up bathroom fixtures, evidence of roaches, broken windows and missing screens. House open to public. 3. BALDWIN PARK POLICE DEPARTMENT: There are no crime reports at this location. The main patrol problem is that there are two wooden shacks on the property that are not secured and are accessible to anyone for unauthorized uses.. Recommend the wo6den shacks at the rear either be demolished or secured to prevent entry. 4. BALDWIN PARK PLANNING DEPARTMENT: The structure on this property does conform to the present zone and general plan. Garage side setback area appears to be on property line. Recommend general lot cleanup and demolition of the substandard structures in the rear of the property. 5. BALDWIN PARK BUILDING DEPARTMENT: This structure is posted as unsafe for human occupancy. There are electrical and plumbing violations. Recommend removal of rear buildings and bring dwelling to code. It is recommended that the Public Nuisance be abated by the following; 1. Demolish or rehabilitate enclosed patio, picture E. 2. Demolish or rehabilitate car-port, picture F. 3. Rehabilitate both garage and dwelling, or immediately secure both buildings.
