HomeMy WebLinkAbout1972 076 CC RESO1972 076 CC RESO(ÌìýÅÔÏRESOLUTION NO. 72- 76 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED. 72-N-23) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows; a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 3156 Frazier Street more particularly described as follows: Tract No. 718 Lot commencing Southerly 50° 53' 30" Easterly 433.68 feet and Northerly 39° 06' 30" Easterly 182 feet from Most Westerly corner of Lot 42 Thence Northerly 50° 53' 30" Westerly 230.68 feet Thence Northerly 39° 06' 30" Easterly 131 feet Thence Northerly omitted portion in Assessor's Map Book part of Lot 42. 8551-16-19) 72-N-23) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, con- stitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance; and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abate- ment is not accomplished, as required hereby, within 60___days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of the Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. The residence and auxiliary building are substandard requiring the following corrections: a. Remove by demolition barn and horse corral in the rear yard, b. Unvented heater in the front house. Provide a vent. c. Windows and screen are missing. d. Replace all hazardous wiring and provide 100 amp service. e. Fireplace is defective and separating from the house demolish or repair, f. Provide fumigation certificate. The staff makes the following recommendations: 1. Demolish barn and horse corral in rear yard. 2.
