HomeMy WebLinkAbout1972 096 CC RESO1972 096 CC RESO(Ììþ¯ÔÏRESOLUTION NO. 72-96 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED. 72-N-36) THE CITY COUNCIL OF TH15 CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 4958 Maine Avenue more particularly described as follows: Lot commencing southerly 0034130" westerly 52.5 feet and southerly 89°56'30" easterly 35 feet from north- westerly corner of southwesterly h of northwesterly h of Section 8 Township 1 South Range 10 west thence 0034930n west 52.5 feet thence south 89°56'30" east omitted portion in Assessor's Map Book of Lot 8. 8414-11-2) 72-N-36) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance; and that the public in- terest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2, That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 60 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of the Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. Structure has the following building violations: 1. Gas shut off valve required for kitchen stove pipe. 2. Have floor furnace certified as operable or replace. 3. Roof vent for kitchen stove is too small must have minimum of 8" opening for gravity flow. 4. Replace all broken windows and replace all missing screens including foundation vent screens. 5. Exposed wiring in the garage. 6. Paint up and fix up. 7. Repair sunshade in the rear yard; hazardous and needs new supports. 8. Addition to rear of garage is not up to Municipal Building Code and requires considerable rehabilitation. 9. Provide fumigation report. After careful review of the subject property, the staff deter- mined that the property should be declared a Public Nuisance and recommends the following: 1. Board up and secure front structure. 2. Rehabilitate or demolish addition to garage and sunshade- 3. Conduct a general lot clean up.
