HomeMy WebLinkAbout1972 108 CC RESO1972 108 CC RESO(ÌìþÓÔÏRESOLUTION NO. 72-108 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED. 72-N-32) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: Section 1. Tliat the City Council of the City of Baldwin Park docs hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq-, of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 3230 Frazier Street more particularly described as follows: Tract No. 718 lot except that portion of dedicated street) commencing southerly 39006130" westerly 88 feet from most northerly corner of Lot 42 thence southerly 39006130" westerly 18 feet thence southerly 50°53'30" easterly 200 feet thence southerly 39006130" westerly 70 feet thence southerly 50 feet omitted portion in Assessor's Map Book part of Lot 42. 8551-17-20) 72-N-32) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildings and structures on said property, in their present state, con- stitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance; and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference, SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abate" ment is not accomplished, as required hereby, within 30 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of the Resolution and cause copies hereof to be forwarded as prescrib- ed by the Baldwin Park Municipal Code. Case No. 72-N-33 deals with 3232 Frazier Street. Minor building Code violations are not noted due to dwelling being secured. After careful review of the subject property, the staff determined that the property should be declared a public nuisance and recommends the following action: 1. Any or all sheds located on this property due to their condition should be demolished or rehabilitated to the present Uniform Building Code. 2. Conduct a major yard clean up including weeds.
