HomeMy WebLinkAbout1972 111 CC RESO1972 111 CC RESO(ÌìüÇÔÏRESOLUTION NO. 72-111 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED. 72-N-42) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 5108 Eiton Street more particularly described as follows: Lot commencing 0°45'02" easterly 720 feet from southeasterly corner of easterly h of westerly h of northwesterly h of northeasterly h of Section 8 Township 1 South Range 10 West thence northerly 0°45'02" easterly 60 feet thence northerly 89°57'30" west to east line of Eiton Street omitted portion in Assessor's Map Book of northeast- erly h of Lot 8. 8413-10-16) 72-N-42) c) That a duly noticed public hearing having been conducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the Buildings and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance; and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 60 days from the date hereof, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of the Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. Structure has considerable building violations; 1. Very poor foundations, missing in portions, termite damage, etc. 2. Sagging floor supports caused by termite damage. 3. Defective roof. 4. Plumbing below mimimum code. 5. Electrical below minimum code. After careful review of the subject property the staff de- termined that the property should be declared a Public Nuisance and recommends the following action: 1. Demolish or rehabilitate to Ml Zoning requirements. 2. Conduct a major yard clean up.
