A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK ESTABLISHING
A REVISED POLICY FOR PAVEMENT HOOKUPS
WHEREAS, the City of Baldwin Park adopted Resolution No.
61-21 establishing a policy regarding pavement hookups; and
WHEREAS, the City Council of the City of Baldwin Park desires
to amend and change said policy as it heretofore has applied to pave-
ment hookups; and
WHEREAS, the City of Baldwin Park is generally in need of
curbs, gutters and pavement hookups throughout the City; and
WHEREAS, the city does not have sufficient funds to undertake
this project in its entirety at city expense? and
WHEREAS, the City Council desires to establish a policy as a
guide for municipal expenditure and a stimulus for private partici-
pation in such program,
NOW, THEREFORE, the City Council of the City of Baldwin Park
does resolve as follows:
SECTION 1. The city will install pavement hookups at muni-
cipal expense, as funds become available on all Select System Streets
and non-Select System Streets where residentially zoned and residentiaily
used properties exist, but only where the property owner has granted
ultimate dedication for street purposes to the city.
SECTION 2. All other pavement hookups will be installed at the
expense of the property owner.
SECTION 3. It is believed that this policy will result in the
greatest benefit to the city as a whole since streets in residential
areas are likely to experience greater use and the incentive to resi-
dential property owners to have the street paved at municipal expense
will stimulate such owners to install curbs, gutters and dedicate the
area needed for street widening much sooner than would otherwise be the
case.
SECTION 4. The policy herein declared shall not apply to sub-
divisions, nor is it intended that any property owner who installs curbs,
gutters and makes dedication pursuant hereto shall have any recourse
against the city legally.
