HomeMy WebLinkAbout1972 160 CC RESO1972 160 CC RESO(ÌìýpÔÏRESOLUTION NO, 72-160 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK REQUESTING THE SUPPORT OF OTHER CALIFORNIA CITIES IN FILING LITIGATIOI^ TO TEST THE VALIDITY OF THE METHOD OF APPORTIONING SALES TAX UNDER THE BRADLEY-BURNS UNIFORM LOCAL SALES AND USE TAX LAW WHEREAS, recent interpretations of the Fourteenth Amendment's equal protection clause by State and Federal courts casts significant doubt' upon the constitutionality of the present method of apportioning sales tax, and WHEREAS, such apportionment is made according to the location in which the sale occurred, and WHEREAS, such a formula is entirely disproportionate and unrelated to the fiscal needs of cities and bears little relation to the necessary local services arising fro? such sale, and WHEREAS, the competition between cities to attract industries generating high sales tax has redounded to the detriment of citizens, often resulting in poor planning, an inferior quality of life and irrevocable harm to community values, and. WHEREAS, repeated attempts by California cities to accomplish a more equitable apportionment of sales tax by new State legislation have been thwarted by powerful, organized opposition, and WHEREAS, the League of California Cities hd^ been unab^- to support legislation for viable sales tax reforr. because of the dichotomy of interest in its member cities, and WHEREAS, it is apparent that the only recourse open to affected cities is judicial review, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Baldwin Paric that all California cities are requested to assist the City of Baldwin Park in filing appropriate litigation to test the validity of the method of apportionment of the sales tax. BE XT FURTHER RESOLVED that copies of this R^olution be sent to all California cities, the League of California Cities, and' other key officials and organizations.
