HomeMy WebLinkAbout1973 006 CC RESO1973 006 CC RESO(Ììý‘ÔÏRESOLUTION NO. 73-6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DENYING AN APPLICATION FOR A CONDITIONAL USE PERMIT APPLICANT: MARQUEZ; LOCATION: 1309 VIRGINIA AVENUE; CASE NO: CUP-186). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare, as follows: a) That the owners of certain real property located at 1309 Virginia Avenue in the City of Baldwin Park, County of Los Angeles, State of California, more particularly described as Parcel 22, Page 31 of the 1972 Los Angeles County Assessors Map Book No. 8558, heretofore made application for a con- ditional use permit to allow the operation and maintenance on said property of a dog kennel; and b) That the Planning Commission con- sidered said application and thereafter, denied the same; and c) That a timely appeal was filed, appealing the decision of the Commission to the City Council; and d) That the City Council conducted a duly noticed public hearing upon said appeal, and based upon the evidence presented, and each member of the City Council being familiar with the site and with the Planning Commission's records and files, including but not limited to, the minutes of the Planning Commission's hearing with reference to said application, determined that the said matter should be denied for the reasons hereinafter set forth* SECTION 2. That the above described conditional use permit application be, and the same hereby is, denied for the reasons that: a) That the proposed use will be incompatible with surrounding and adjacent existing residential uses; and b) That the said proposed u6e would be inconsistent and incompatible with proposed and prospective industrial park type develop- ments with reference to properties abutting Virginia Avenue in the immediate area of the subject property; BIB] 37691-U01 1973-U02 006-U02 CC-U02 RESO-U02 LI3-U03 FO10488-U03 FO11313-U03 DO11711-U03 C6-U03 RESO-U03 3/10/2003-U04 ROBIN-U04 1973 006 CC RESO(Ììý‘ÔÏRESOLUTION NO. 73-6 c) That the City's General Plan relating to this area describes and proposes said area to be developed for Industrial purposes; that In furtherance of said General Plan concept, an assessment district, Involving the expenditure of $ 294/126,44 resulted In the reconstruction, widening and extension of Virginia Avenue which was accomplished jointly by the City and the property owners In the area, for the purpose of providing a suitable Industrial street to serve Industrial developments; and the proposed use hereunder would be detrimental and have an adverse effect upon such pro- posed development of properties, adjacent to, and In the Immediate vicinity of, Virginia Avenue; and d) That the public Interest, con- venience and necessity require that the said application be denied. SECTION 3. That the City Clerk shall certify the adoption of this Resolution and forward a certified copy hereof to the Secretary of the Planning Commission and to the applicant.
